Following a Public Hearing in the National Capital Region beginning on 11 June 1990, the Commission renews the licences for the broadcasting receiving undertakings serving the communities noted above, held by N1 Cable TV Ltd. (N1), from 1 October 1990 to 31 August 1995. The operation of these undertakings is regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations) and the licences will be subject to the conditions specified in this decision and in the licences to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of each licence, to continue to distribute The Atlantic Satellite Network, (ASN), received via satellite, provided that it is distributed on an unimpaired channel of the basic service of each undertaking except at La Scie. The Commission notes N1 does not distribute ASN at La Scie.
The Commission acknowledges the interventions by the Community Council of Sandy Cove and the Town of Eastport opposing the renewal of the licence for the Eastport system because cable service is not available to all potential subscribers within their municipalities. In reply, N1 stated that the area at issue primarily contains summer cottages which are outside its licenced area. N1 further claimed that it is not financially feasible to extend service to these cottages at this time because the area does not have an adequate utilities infrastructure to support a cable system. However, N1 did indicate its willingness to provide service to this location if the telephone company were to install the necessary pole lines. The Commission is satisfied with the licensee's reply.
