In Public Notice CRTC 1990-18, the Commission issued, for public comment, a proposed amendment to the definition of "alphanumeric service" as contained in Section 2 of the Cable Television Regulations, 1986 in order to broaden this definition to permit the inclusion at paragraph "d" of "the Canadian programming service of a licensed national audio network operation" as background audio. The Commission received two responses to this notice.

The Canadian Cable Television Association supported the proposed amendment. In its submission, Météomédia Inc. suggested that the Commission consider establishing Canadian musical content requirements and a licensing framework for background music services. The Commission notes, however, that the nature of these concerns are such that they would be more appropriately considered in another proceeding. It therefore concludes that no submission has been received that would indicate that the proposed amendment should not be enacted as proposed.

Accordingly, on the recommendation of the Executive Committee, the Commission approved, on 30 May 1990, the amendment to the Cable Television Regulations, 1986 as it appeared in the schedule attached to Public Notice CRTC 1990-18.

The amendment, which is included in the schedule attached to this notice, was registered on 1 June 1990 (SOR/90-321) and came into force on that date.

Cable Television Regulations, 1986, amendment
|
Whereas, pursuant to subsection 6(2) of the Broadcasting Act, a copy of proposed amendments to the Cable Television Regulations, 1986*, substantially in the form set out in the schedule hereto, was published in the Canada Gazette Part I on February 24, 1990 and a reasonable opportunity was thereby afforded to licensees and other interested persons to make representations with respect thereto:

Therefore, the Canadian Radio-television and Telecommunications Commission, on the recommendation of the Executive Committee of the commission, pursuant to subsection 6(1) of the Broadcasting Act, hereby amends the Cable Television Regulations, 1986, made on July 30, 1986*, in accordance with the schedule hereto.

SCHEDULE
|
1. The definition "alphanumeric service"** in section 2 of the Cable Television Regulations, 1986 is revoked and the following substituted therefor:
|
""alphanumeric service" means a service that consists of letters, numbers, graphic designs or still images, or any combination thereof, that may be accompanied by
|
(a) background music.
|
(b) the programming service of a licensed A.M. station or licensed F.M. station, other than an educational radio programming service the operation of which is the responsibility of an educational authority.
|
(c) the service of Weather Radio Canada.
|
(d) the Canadian programming service of a licensed national audio network operation, or
|
(e) spoken words that simply and briefly explain or describe what is represented by the letters, numbers, graphic designs or still images; (service alphanumérique)"

This amendment broadens the definition "alphanumeric service" to permit the inclusion of the Canadian programming service of a licensed national audio network operation as background audio.
