La Belle Vision Inc.

Following a Public Hearing in the National Capital Region beginning on 11 June 1990, the Commission renews the licence for the broadcasting receiving undertaking serving Sainte-Gertrude, held by La Belle Vision Inc., from 1 September 1990 to 31 August 1995. The operation of this undertaking is regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to distribute, at its option, WPTZ (NBC) and WCFE-TV (PBS) Plattsburgh, New York, and WCAX-TV (CBS) and WVNY (ABC) Burlington, Vermont, received via microwave, as part of the basic service.
The Commission approves the licensee's request with respect to section 23 of the regulations. Accordingly, it is a condition of licence that the licensee be relieved of the requirement that it distribute at least four television programming services delivered to its local head end by a network operator licensed to extend television and radio services to remote and underserved communities, at least one of which must be a Canadian television programming service.
In considering the above request, the Commission has taken into account the licensee's argument that since the Sainte-Gertrude undertaking is linked to a regional head-end, that of Intervision de la Mauricie, it can distribute the U.S. signals delivered by Microbec rather that those provided by the CANCOM network. In this case, the Commission is of the view that this approval is in the interest of the subscribers. The Commission notes the written intervention submitted by Canadian Satellite Communications Inc. concerning this request.
