Following a Public Hearing in Quebec City beginning on 5 December 1989, the Commission approves the application by Guy Keays for a licence to carry on a broadcasting receiving undertaking to serve Saint-Alexandre-des-Lacs. The operation of this undertaking will be regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations). The Commission will issue a licence expiring 31 August 1994, subject to the conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the applicant is authorized to distribute, at its option, CFJP-TV Montreal, received via satellite, as part of the basic service.
The Commission also approves the applicant's request to be relieved of the requirement of section 23 of the regulations. Accordingly, it is a condition of licence that the applicant be relieved of the requirement that it distribute at least four television programming services delivered to its local head end by a network operator licensed to extend television and radio services to remote and underserved communities, at least one of which must be a Canadian television programming service, so long as the applicant does not distribute any U.S. services.
In assessing this request, the Commission has taken into account the range of programming services proposed and it considers that the distribution of additional English-language CANCOM services is not justifed for the subscribers who will be almost exclusively francophone.
Further, the Commission approves by condition of licence, the applicant's request that it be relieved of the requirement of paragraph 22(1)(b) of the regulations with respect to the distribution of regional service CIVB-TV (SRTQ) Rimouski in view of the poor reception quality of this signal, which has been confirmed by the Department of Communications (DOC). Instead, the applicant proposes to distribute the programming of CIVM-TV (SRTQ) Montreal, received via satellite.
It is a condition of licence that construction of this undertaking be completed and that it be in operation within twelve months of the date of this decision or, where the applicant applies to the Commission and satisfies the Commission that it cannot implement its authority before the expiry of this twelve-month period and that an extension of this period is in the public interest, within such further period of time as is approved in writing by the Commission.
