Following a Public Hearing in Montreal beginning on 13 March 1990, the Commission renews the Class 1 licence for the broadcasting receiving undertaking serving Victoriaville, held by Vidéotron Ltée, from 1 October 1990 to 31 August 1994. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.

This term will enable the Commission to consider the renewal of this licence at the same time as that of other cable systems in the area.

In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to continue to distribute, at its option, CFCF-TV Montreal, received via microwave, as part of the basic service.

The licensee is also authorized to continue to distribute, at its option, WVNY (ABC) and WCAX-TV (CBS) Burlington, Vermont, and WPTZ (NBC) and WCFE-TV (PBS) Plattsburgh, New York, received via microwave, as part of the basic service.

The Commission further approves the licensee's request to be relieved, by condition of licence, from the requirement of paragraph 9(1)(f) of the regulations, to distribute, as part of its basic service and on the basic band if channels are available, the programming service of an English-language television station owned and operated by the CBC and distributed via satellite or microwave relay. The Commission notes that the licensee proposes to distribute, in lieu of such service, CBMT Montreal which is a distant English-language service owned and operated by the CBC and received over-the-air.

The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the annual budgets which will be allocated for this purpose during the new licence term. The Commission expects the licensee to increase its community programming budget during the next licence term in order that the percentage of revenue set aside for community programming will at least be equal to that of the Cap-de-la-Madeleine undertaking.

The Commission acknowledges the written intervention submitted by TVOntario opposing the distribution of its French-language service ("La Chaîne française") by the licensee. The Commission notes that the licensee's proposed distribution does not include TVOntario's signal.
