Following a Public Hearing in Montreal beginning on 13 March 1990, the Commission approves the applications by Guy Keays, representing a company to be incorporated for licences to carry on broadcasting receiving undertakings to serve the communities noted above. The operation of these undertakings will be regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations).

The Commission will issue licences expiring 31 August 1994, subject to the conditions specified in this decision and in the licences to be issued.

This authority will only be effective and the licences will only be issued at such time as the Commission receives documentation establishing that the company has been incorporated in accordance with the applications in all material respects.

In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the applicant is authorized to distribute, at its option, CFJP-TV Montreal, received via satellite as part of the basic service of each undertaking.

The Commission approves the applicant's request with respect to section 23 of the regulations. Accordingly, it is a condition of licence that the applicant be relieved of the requirement that it distribute at least four television programming services delivered to its local head end by a network operator licensed to extend television and radio services to remote and underserved communities, at least one of which must be a Canadian television programming service, so long as the applicant does not distribute any U.S. television station.

In assessing this request, the Commission has taken into account the range of programming services proposed and the fact that the communities to be served will be predominantly French speaking. The Commission has also noted the intervention from Canadian Satellite Communications Inc. (CANCOM) in this regard.

Further, with respect to the proposed undertaking at Lac-Humqui, the Commission approves by condition of licence, the applicant's request that it be relieved of the requirement of paragraph 22(1)(a) of the regulations with respect to the distribution of local services CIVB-TV (SRTQ) and CFER-TV (TVA) Rimouski in view of the poor reception quality of these signals, which has been confirmed by the Department of Communications (DOC). Instead, the applicant proposes to distribute the programming of CIVM-TV (SRTQ) Montreal, received via satellite and CHAU-TV-1 (TVA) Sainte-Marguerite-Marie, a regional signal. It is a condition of this licence that construction of this undertaking be completed and that it be in operation within twelve months of the date of this decision or, where the applicant applies to the Commission within this period and satisfies the Commission that it cannot complete implementation before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission.
