Following a public hearing in the National Capital Region on 27 June 1989, the Commission approves the application for a licence for a French-language FM radio broadcasting transmitting undertaking at Rouyn-Noranda, on the the 90.7 MHz frequency, channel 214B, with an effective radiated power of 16,000 watts, to rebroadcast programs originating in part from its Rouyn-Noranda studios and in part from CBF Montreal.
The Commission will issue a special FM licence expiring 31 August 1994, subject to the conditions specified in this decision and in the licence to be issued.
In Decision CRTC 89-677 of today's date, the Commission has approved an application by Radio Nord Inc. to operate an FM radio broadcasting transmitting undertaking at Amos/ Val-d'Or, which will rebroadcast the service herein authorized.
The new station will broadcast 132 hours 45 minutes per week of programming of which 108 hours 50 minutes will originate from the CBC's French-language AM radio network originating with CBF Montreal. The licensee will produce the remaining 23 hours 55 minutes from its Rouyn-Noranda studios. The regional programs will be braodcast in the morning and late afternoon and will be similar in format to those of the CBC: they will include interviews and commentary on regional news events, features, reports on social and cultural events in the region and music. The applicant has committed not to broadcast any commercials, including during those periods when regional programming is being broadcast.
Communications Cuivor Inc., licensee of CJMM-FM Rouyn-Noranda and CJMV-FM Ville-Marie, filed an intervention opposing the establishment of new radio stations in the Abitibi/ Témiscamingue market. It pointed out that this is a fragile market and [TRANSLATION] "should not be subjected to the repercussions that would result from the introduction of new undertakings until the existing stations have achieved some measure of equilibrium". It added that the Commission should require that Radio Nord Inc. file a copy of its agreement with the CBC relating to the carriage of CBC programs by the new stations in Rouyn-Noranda and Amos/Val-d'Or. In reply, Radio Nord Inc. explained that the applications to disaffiliate CHLM-MF Rouyn-Noranda from the CBC's French-language AM radio network and to operate new stations that would rebroadcast programs received from that network were filed in response to Public Notice CRTC 1988-130 relating to the improvement of radio service in the Abitibi/Témiscamingue region. The licensee also pointed out that approval of these applications would enable it to regularize the situation with respect to frequency utilization and to provide residents of the Abitibi/ Témiscamingue area with the kind of homogeneous and consistent programming that is offered by stations operating in the Group I music format. It added that a copy of its agreement with the CBC had been filed with the Commission.
The Commission also authorizes Radio Nord Inc. to make use of the Subsidiary Communications Multiplex Operation. The Commission expects the applicant to adhere to the guidelines set out in Appendix A to Public Notice CRTC 1989-23 dated 23 March 1989 entitled Services Using the Vertical Blanking Interval (Television) or Subsidiary Communications Multiplex Operation (FM). This authority may only be implemented when the Department of Communications (DOC) gives the technical approval required by the Radio Act and regulations made thereunder.
The DOC has advised the Commission that this proposal is technically acceptable, but that issuance of a Technical Construction and Operating Certificate is conditional upon the resolution of any problems involving interference with aeronautical NAV/ COM services.
In accordance with paragraph 13(1)(b) of the Broadcasting Act, the Commission will only issue the licence, and the authority granted herein may only be implemented, at such time as written notification is received from the DOC that it will issue a Technical Construction and Operating Certificate.
It is a condition of licence that the authority granted herein be implemented within twelve months of the date of written confirmation by DOC that it will issue a Technical Construction and Operating Certificate or, where the applicant applies to the Commission and satisfies the Commission that it cannot implement its authority before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission.
In its application, the applicant undertook not to broadcast any advertising other than that contained in the programs originating with the CBC. Accordingly, during those periods when programs originating with the CBC are being broadcast, by condition of licence, the applicant shall not broadcast any commercial message except
(a) in programs which are available to the applicant only on a sponsorship basis,
(b) as required to fulfill the requirements of applicable legislation of the Parliament of Canada concerning elections,
(c) material falling into content subcategory 81, or
(d) competitions or contests intended or used to encourage listening to the station or any verbal or musical material promoting such contests without identification of a sponsor. It is a condition of licence that the applicant adhere to the Canadian Association of Broadcasters' (CAB) self-regulatory guidelines on sex-role stereotyping, as amended from time to time and approved by the Commission.
