Decision

Ottawa, 14 August 1989
Decision CRTC 89-562
Classic Communications Ltd.
Vaughan, Richmond Hill, Markham, Whitchurch and Stouffville, Ontario - 881038400 - 881039200
Following a Public Hearing in Toronto on 13 March 1989, the Commission approves the applications to change the authorized service area for the broadcasting receiving undertaking serving the communities noted above by including King City and that part of the Township of King not already licensed.
In CRTC - Notice of Public Hearing 1989-1 dated 13 January 1989, the Commission announced that both Classic Communications Ltd. (Classic) and Rogers Cable TV Limited, licensee of the cable system serving Newmarket, Ontario, had applied to extend their authorized service areas to include King City and the rest of the unlicensed area of the Township of King. Rogers Cable TV Limited subsequently withdrew its application (873732200).
In approving these applications, the Commission has taken into consideration Classic's experience in serving communities in southern Ontario and the resources upon which it may draw in extending and improving service in the area. The Commission also notes the licensee's undertaking to provide the same programming services in the extended areas as are currently available to its other subscribers and that the same basic monthly fee will be charged throughout the licensed area.
The Commission acknowledges the supporting interventions received from elected officials from the region, namely the Members of Parliament for York Centre, York North and Markham and the Mayors of Vaughan, Markham, Richmond Hill and Whitchurch-Stouffville.
This approval is conditional upon construction in the extended area being completed and the extended system being in operation within twelve months of the date of this decision or, where the licensee applies to the Commission within this twelve-month period and satisfies the Commission that it cannot complete the construction and begin the operation of the extended system before the expiry of this period and that an extension is in the public interest, within such further period of time as is approved in writing by the Commission.
