Following a Public Hearing in Quebec City on 13 March 1989, the Commission renews the licence for the broadcasting receiving undertaking serving Saint-Cyprien held by Télécâble St-Cyprien Inc., from 1 October 1989 to 31 August 1994. The operation of this undertaking is regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.

In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distribute, at its option, CFJP-TV (TQS) Montreal, received via satellite, as part of the basic service.

The Commission approves, by condition of licence, the proposal to distribute the complete programming service of TCTV (TVA) Montreal, received via satellite from the CANCOM network, even though the local TVA affiliate, CIMT-TV Rivière-du-Loup, distributes most of the same programming. In approving this application, the Commission has considered the very small size of this Part III undertaking and the fact that the programming offered by TCTV is now almost identical to that offered by the TVA affiliate and it considers that carriage of the complete TCTV service should have little impact on the TVA affiliate's revenues. The Commission has also taken into consideration the interventions from the Réseau de Télévision TVA Inc., the Pathonic Network Inc. and Télé Inter-Rives Limitée opposing the distribution of the TCTV service.

The Commission approves, by condition of licence, the licensee's request that it be relieved of the requirement of paragraph 22(1)(b) of the regulations with respect to the distribution of regional service CFTF-TV (TQS) Rivière-du-Loup in view of the poor reception quality of this signal.

The Department of Communications has advised the Commission that it is prepared to renew the Technical Construction and Operating Certificate for a period of two years only, expiring 30 September 1991. With respect to the operation of this undertaking beyond this period, the Commission draws the licensee's attention to paragraph 13(1)(b) of the Broadcasting Act pertaining to the technical certification of broadcasting undertakings and to subsection 13(2) which provides that any broadcasting licence issued, amended or renewed in contravention of section 13 is of no force or effect.
