Following a Public Hearing in Quebec City on 13 March 1989, the Commission renews the licence, held by Marcel Parent, for the broadcasting receiving undertaking serving Saint-Camille from 1 October 1989 to 31 August 1994.
In submitting the renewal application, the licensee has requested the addition of a condition of licence authorizing it to act as a Part III licensee, under the applicable sections of the Cable Television Regulations, 1986 (the regulations).
In examining this request, the Commission has taken into consideration the fact that the licensee was authorized prior to 1981 to distribute a U.S. television service, which service is still being distributed. Further, the Commission notes that the licensee has not provided convincing evidence in support of its request. In light of the foregoing, the Commission denies the licensee's request to act as a Part III licensee.
The operation of this undertaking is accordingly regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to continue to distribute, at its option, CKMI-TV Quebec City, received over-the-air, CFJP-TV Montreal and La Chaîne française, received via satellite, as part of the basic service. The Commission reminds the licensee that La Chaîne française may only be distributed if there is no objection from TVOntario.
The Commission approves, by condition of licence, the request to be relieved from the requirement of paragraph 9(1)(f) of the regulations to distribute, as part of the basic service and on the basic band if channels are available, the programming service of an English-language television station owned and operated by the Canadian Broadcasting Corporation and distributed to the licensee via satellite or microwave relay. The Commission notes that the licensee proposes to continue to distribute distant station CKMI-TV Quebec City, which is affiliated with the CBC's English-language television service.
The Commission also approves, by condition of licence, the licensee's request to be relieved of the requirement that it distribute, pursuant to paragraph 9(1)(i) of the regulations, extra-regional television service CFAP-TV (TQS) Quebec City, in view of the poor reception quality of this signal.
