Following a Public Hearing in Vancouver on 20 February 1989, the Commission renews the Class 1 licence for the broadcasting receiving undertaking serving Victoria, Saanich, Esquimalt and Oak Bay, held by Rogers Cable T.V. Limited (Rogers), from 1 October 1989 to 31 August 1993. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distribute, at its option, KVOS-TV (IND) Bellingham, KIRO-TV (CBS), KOMO-TV (ABC), KING-TV (NBC) and KCTS-TV (PBS) Seattle, KSTW-TV (IND) and KCPQ-TV (IND) Tacoma, Washington, received via microwave, as part of the basic service, and the audio services of The Nashville Network and the Arts and Entertainment Network, received via satellite, on audio channels of the undertaking.
Pursuant to section 12 of the regulations, by condition of licence, the licensee is relieved of the obligation that it distribute the programs of CHEK-TV Victoria on an unrestricted channel. Should the quality of the signal deteriorate significantly, the licensee will be expected to undertake immediate corrective action such as moving the service to another channel.
The Commission acknowledges the intervention received from the British Colombia Television Broadcasting System Ltd. regarding the distribution of CHAN-TV Vancouver on a restricted channel. It notes that CHAN-TV is not distributed on a restricted channel.
The licensee is also authorized to continue to distribute, at its option, without commercial messages, the special programming service consisting of pay television promotional material (barker channel).
The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the annual budgets which will be allocated for this purpose during the new licence term. In light of the resources available to the licensee, the Commission expects it to continue its efforts to develop community programs that reflect subscriber interests and concerns.
An intervention was received from Mr. John H. Rennie expressing concern about the basic monthly fee charged to subscribers and the recent move of a U.S. network programming service from the basic band to the augmented service. Further, Mr. Kelly Bert Manning intervened to oppose the distribution of a non-programming service on the basic band. The Commission is satisfied with the licensees' responses, noting that the proposed distribution of the ABC network service and all priority signals are in accordance with the regulations.
