Following a Public Hearing in Quebec City on 13 March 1989, the Commission renews the licence for the broadcasting receiving undertaking serving Saint-Vital-de-Lambton held by La Guadeloupe Télévision Inc. from 1 October 1989 to 31 August 1994. The operation of this undertaking is regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distribute CFJP-TV (TQS) Montreal, as part of the basic service.
The licensee has asked to be relieved of the requirement of paragraph 22(1)(b) of the regulations that it distribute regional service CBVT-6 Beauceville. In support of its request, the licensee indicated that it will distribute extra-regional station CBVT Quebec City which carries identical programming and that it would be more expensive to distribute CBVT-6. The Commission has taken into consideration the licensee's arguments, particularly the poor reception quality of CBVT-6, and the intervention received from the CBC opposing this request. In light of the foregoing, the Commission approves the licensee's request and, therefore, it is a condition of licence that the licensee be relieved of the requirement that it distribute CBVT-6.
The Commission has also considered the range of Canadian and francophone programming services carried on the system, that it has never been authorized to distribute U.S. television signals received via the CANCOM network and that it distributes two U.S. services received over-the-air. The Commission considers that an exemption to the requirement, pursuant to section 23 of the regulations, is justified in this case. Accordingly, it is a condition of licence that the licensee be relieved of the requirement that it distribute at least four television programming services delivered to its local head end by a network operator licensed to extend television and radio services to remote and underserved communities, at least one of which must be a Canadian television programming service, so long as the licensee distributes only two U.S. television stations.
