Pursuant to Public Notice CRTC 1988-54 dated 7 April 1988, the Commission approves the application by Communications Cuivor Inc. (Cuivor) to amend the broadcasting licence for CJMV-FM Val-d'Or by increasing the effective radiated power from 49,400 watts to 63,100 watts and by relocating the transmitter to a site adjacent to the one authorized in Decision CRTC 87-558 dated 10 July 1987.
Public Notice CRTC 1988-54 had inadvertently referred to the currently authorized effective radiated power as being 40,800 watts.
The Commission noted in that decision that Cuivor (formerly 149178 Canada Inc.) had not yet completed its negotiations regarding access to and sharing of the antenna site at Lithium Mines with Radio Nord Inc., the owner of the transmitter site, and with the Canadian Broadcasting Corporation, a lessee of the site. Further, Communications Canada had concerns about the site chosen and stated that the proposal to locate a transmitter at Lithium Mines is "a special case acceptable under certain conditions" only.
In Decision CRTC 87-558, the Commission expected Cuivor to take all necessary measures to comply with Communications Canada's requirements and to obtain the required Technical Construction and Operating Certificate on or before 10 October 1987. Following a request by the licensee, the Commission approved an extension of the deadline for complying with the requirement to obtain technical certification until 10 October 1988 (Approval No. A87-0196 dated 17 November 1987).
As the negotiations referred to above were unsuccessful, the licensee has filed the present application to use a different antenna site in order to satisfy Communications Canada's requirements having negotiated an agreement with Cambior Inc., a mining company, and with the municipality of Lacorne, Quebec.
In its assessment of Cuivor's application, the Commission has also taken into account the intervention and supplementary brief received from Radio Nord Inc., licensee of six radio stations in the Abitibi area, opposing the changes on the grounds that they will significantly alter Cuivor's original technical and financial proposals, as well as Cuivor's reply.
After careful consideration of the information available to it, the Commission is satisfied that the proposed changes will not significantly alter Cuivor's original application for CJMV-FM Val d'Or. As a result of these changes, Cuivor will operate its own radio transmitter site and, as it has stated in its application and in its reply to the intervention, Cuivor considers that these technical modifications will improve the signal quality in the authorized service area.
