Following a Public Hearing in Trois-Rivières, Quebec on 5 July 1988, the Commission renews the Class 2 licence, held by Fred Lang T.V. Limited for the broadcasting receiving undertaking serving Kirkland Lake and Swastika, from 1 October 1988 to 31 August 1993. The operation of this undertaking will be regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.

In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to continue to distribute, at its option, CIII-TV Toronto, received via microwave, as part of the basic service.

The Commission is satisfied that the distribution of CIII-TV is in line with the guidelines set out in Public Notice CRTC 1985-61 with respect to the cable distribution of distant Canadian television signals.

The licensee is also authorized to continue to distribute, at its option, the programming of WGRZ-TV (NBC), WIVB-TV (CBS) Buffalo and WOKR-TV (ABC) Rochester, New York, received via microwave, as part of the basic service.

The Commission notes that the licensee has proposed to continue to distribute the local television stations CFCL-TV-2 and CITO-TV-2 Kearns on restricted channels. Pursuant to section 12 of the regulations, it is a condition of licence that the licensee not be required to distribute CFCL-TV-2 and CITO-TV-2 on unrestricted channels. Should the quality of either signal deteriorate, the licensee will be expected to take immediate corrective action such as moving the service to another channel.

The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the resources which will be allocated for this purpose during the next licence term. In view of the size of the system and the fact that its annual returns indicate that its financial position is sound, the Commission expects the licensee to increase its resources for community programming during the next licence term. In this respect, the Commission requires the licence to report, within three months of the date of this decision, addressing the Commission's expectation.
