Rogers Cable T.V. Limited

Following a Public Hearing in Calgary on 1 June 1988, the Commission renews the Class 1 licence for the broadcasting receiving undertaking serving part of Calgary and Crossfield, held by Rogers Cable T.V. Limited (Rogers), from 1 October 1988 to 31 August 1993. The operation of this undertaking is regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations) and the licence will be subject to the conditions specified in this decision and in the licence to be issued.
With respect to that portion of its cable system serving part of Calgary, in addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized to continue to distribute, at its option, as part of the basic service, KSPS-TV (PBS), KHQ-TV (NBC), KXLY-TV (ABC) and KREM-TV (CBS) and, on the audio channels of its undertaking, KMBI-FM, KXLY-FM, KISC, KDRK-FM, KEZE-FM and KZZU Spokane, Washington, all of which are received via microwave. The licensee is also authorized to continue to distribute, at its option, the audio signals of The Arts and Entertainment Network and The Nashville Network, received via satellite, on audio channels of its undertaking.
The licensee is authorized to continue to distribute, at its option, without advertising material, except that contained in programs which are being rebroadcast, replays of Canadian programs broadcast by CFAC-TV Calgary. The Commission also authorizes the distribution, at the licensee's option, of the special programming service consisting of pay television promotional material (barker channel) and, without advertising material, the following special programming services: children's programming, City of Calgary Information Guide, third language programming, and religious programs.
It is a condition of licence that the licensee delete commercial messages from television signals received from broadcasting stations not licensed to serve Canada and substitute therefor suitable replacement material. The licensee is authorized to continue the level and scope of the current deletion and substitution activities. The licensee is not authorized to increase the scope of such activities in any way.
In its renewal application Rogers requested the continuation of a condition of licence, first attached in Decision CRTC 88-141 dated 10 March 1988, which permits alteration of the signals of CBRT, CFCN-TV and CFAC-TV Calgary on the cable system serving the Calgary portion of its licensed area. Rogers has indicated that it wishes to continue its participation in a project initiated by the local television broadcasters and A.C. Nielson for the purpose of conducting research on advertising effectiveness. Accordingly, the licensee is authorized, by condition of licence, to alter the afore-mentioned local television signals to permit substitution of certain signals on the Calgary portion of its cable system for the purpose requested. Consistent with the licensee's proposal, this authority will be effective until 31 August 1990.
Rogers also requested continued relief from the requirement to distribute, when it becomes available, the priority signal of the new Red Deer television station licensed in Decision CRTC 87-352 dated 13 May 1987 because retransmission of the CITV-TV programming to be carried on the Red Deer station could create serious issues regarding program rights. In light of the above, it is a condition of licence that the licensee need not distribute the signal of the Red Deer television station authorized in Decision CRTC 87-352 as part of the basic service only on that part of its cable system serving part of Calgary.
With respect to the Crossfield portion of the system, in addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the licensee is authorized, by condition of licence, to continue to distribute, at its option, CFRN-TV-6 Red Deer, as part of the basic service. The licensee is also authorized to continue to distribute, at its option, KSPS-TV (PBS), KXLY-TV (ABC), KHQ-TV (NBC) and KREM-TV (CBS) and, on audio channels, KMBI-FM, KZZU, KDRK-FM, KISC, KXLY-FM and KEZE-FM Spokane, Washington, all of which are received via microwave.
The Commission is satisfied that the distribution of CFRN-TV-6 at Crossfield is in line with the guidelines set out in Public Notice CRTC 1985-61 with respect to the cable distribution of distant Canadian television signals.
The Commission also advises that pursuant to paragraph 9(1)(b) of the regulations, the licensee is required to distribute the signal of ACCESS Alberta on an unrestricted channel of its basic band and that part of its undertaking serving Crossfield. Accordingly, the licensee is required to report to the Commission, within three months of the date of this decision, confirming that it has complied with the requirements of the regulations.
The Commission reaffirms the particular importance it attaches to the development of community programming and has taken note of the resources which will be allocated for this purpose during the next licence term. The Commission encourages the licensee to continue its efforts with respect to the development of community programs that reflect the interests and concerns of subscribers and expects the licensee to increase during the next licence term both the resources for community programming and the amount of first-run programming it produces, from the current amount of approximately 60 hours per month. In this respect, the Commission requires the licensee report within three months of the date of this decision addressing the Commission's expectation.
