Following a Public Hearing in Edmonton on 16 February 1988, the Commission approves the application for authority to acquire the assets of the broadcasting receiving undertaking serving Camrose from Cable T.V. of Camrose Ltd. (now 96111 Alberta Ltd.), and for a licence to continue the operation of this undertaking upon surrender of the current licence.
The Commission will issue a licence to Cable T.V. of Camrose Inc. (Camrose Inc.) upon surrender of the current licence. The operation of this undertaking will be regulated pursuant to Parts I and II of the Cable Television Regulations, 1986 (the regulations). The licence will expire 31 August 1990, and will be subject to the conditions specified in this decision and in the licence to be issued. This term will enable the Commission to consider the renewal of this licence at the same time as that of other cable systems in the area.
This application, and one by Cable T.V. of Wetaskiwin Inc. (Wetaskiwin Inc.), were submitted in response to Public Notice CRTC 1987-143 in which the Commission specified certain breaches of conditions of licence that had been committed by the licensees of these cable systems.
In its notice, the Commission stated that effective control of the licensee companies had been changed and their assets transferred without prior Commission approval. The notice also stated "it appears that the licensees are not providing cable service to the communities in question and the broadcasting receiving undertakings are being operated without valid licences". In order to "regularize the situation in these communities, and to do so with as little disruption as possible", the Commission stated that it was prepared to consider applications by Camrose Inc. and Wetaskiwin Inc. to provide cable service to the communities of Camrose and to Wetaskiwin and Millet, respectively. The Commission notes that the application by Wetaskiwin Inc. is approved in Decision CRTC 88-193 of today's date.
In its application, Camrose Inc. stated "there is no reason for a rate increase based solely on this transaction". The Commission fully expects the applicant to abide by its clear commitment that subscribers will not be called upon to recover any of the costs of acquiring the system through increased subscriber fees pursuant to sections 18(6) and (8) of the regulations.
In addition to the services required or authorized to be distributed pursuant to the applicable sections of the regulations, the applicant is authorized, by condition of licence, to continue to distribute, at its option, KXLY-TV (ABC), KREM-TV (CBS) and KSPS-TV (PBS) Spokane, Washington, received via microwave, as part of the basic service.
The Commission further approves, by condition of licence, the applicant's requests to add the distribution, at its option, of KISC (KHQ-FM) Spokane and to continue the distribution, at its option, of KXLY-FM, KMBI-FM, KEZE-FM and KDRK-FM Spokane received via microwave.
The Commission also approves, by condition of licence, the distribution, at the applicant's option, of the Knowledge Network of the West Communications Authority (KNOW), as part of the basic service. The Commission is satisfied that the distribution of KNOW is in line with the guidelines set out in Public Notice CRTC 1985-61 with respect to the cable distribution of distant Canadian television signals and that it will enhance the choice of Canadian programming services offered to subscribers.
With respect to the distribution of the local signal of CFRN-TV Edmonton and the CBC Parliamentary Television Network service, the Commission approves the applicant's request to be relieved of the requirements of section 12 of the regulations regarding the distribution of these services on unrestricted channels. In considering this request, the Commission notes that the applicant intends to continue to distribute the signals of CFRN-TV Edmonton and the CBC Parliamentary Television Network service on channels 3 and 13 respectively, where they have been distributed since 1981. The Commission further notes the applicant's assurance that the signals provided will be of good quality.
Accordingly, pursuant to section 12 of the regulations, it is a condition of licence that the applicant is not required to distribute the signals of CFRN-TV and the CBC Parliamentary Television Network on unrestricted channels. Should the quality of the signals deteriorate significantly, the applicant will be expected to undertake immediate corrective action, such as moving the services to other channels.
