Telecom Costs Order CRTC 88-5
In re: Bell Canada (Bell) - 1988 Revenue Requirement, Rate Rebalancing and Revenue Settlement Issues
and -Application for costs by B.C. Old Age Pensioners' Organization, Council of Senior Citizens' Organizations, Federal Anti-Poverty Groups of B.C., West End Seniors' Network and Local 1 217 of the I.W.A. Seniors (BCOAPO et al).
DIRECTION AS TO COSTS
1. The application of BCOAPO et al for an award of costs in respect of the above titled proceeding is hereby approved.
2. The Commission is satisfied that BCOAPO et al has participated in this proceeding in a responsible way and has contributed to a better understanding of the issues by the Commission. The Commission therefore considers that the application of BCOAPO et al meets the requirements set out in paragraphs 44(1)(b) and (c) of theCRTC Telecommunications Rules of Procedure (the Rules).
3. In applying the criterion set out in paragraph 44(1)(a) to a proceeding that is not a general rate increase proceeding under Part III of the Rules, the Commission has recognized that the outcome of this proceeding is of importance to both Bell and B.C. Tel. With this in mind, the Commission has determined that the subscribers represented by BCOAPO et al have a sufficient interest in the outcome of this proceeding to satisfy the requirement in paragraph 44(1)(a).
4. Moreover, this not being a general rate increase proceeding, this application for costs may be considered on its own merits, without reference to the criteria in subsection 44(1). Instead, this application may be assessed in light of section 73 of the National Telecommunications Powers and Procedures Act (NTPPA), which provides the statutory basis for all awards of costs by the Commission. The Commission is satisfied that the application of BCOAPO et al meets the requirements of section 73 of the NTPPA.
5. Costs awarded herein shall be paid to BCOAPO et al as follows: fifty percent by Bell and fifty percent by B.C. Tel.
6. Costs awarded herein shall be subject to taxation in accordance with the the Rules.
7. Costs awarded herein shall be taxed by Allan Rosenzveig.
8. BCOAPO et al shall, within 30 days of the issue of this order, submit a bill of costs and an affidavit of disbursements to the taxing officer and serve a copy thereof on Bell and B.C. Tel.
9. Bell and B.C. Tel may, within two weeks of the receipt of the bill of costs and affidavit of disbursements, file comments with the taxing officer with regard to the costs claimed, and serve a copy thereof on BCOAPO et al.
10. BCOAPO et al may file a reply within two weeks of receipt of Bell's and B.C. Tel's comments, serving a copy thereof on Bell and B.C. Tel.
