Following a Public Hearing in the National Capital Region on 17 February 1987, the Commission approves the application for a broadcasting licence for a low-power English-language FM radio station at Downsview on the frequency 105.5 MHz, channel 288, with an effective radiated power of 50 watts. The Commission will issue a licence expiring 31 August 1990, subject to the conditions specified in this decision and in the licence to be issued.
The applicant is a non-profit corporation without share capital that was incorporated on 29 August 1985. It is operated and mainly funded by York University students.
The approval of this application will provide Toronto with a third student FM station in addition to CKLN-FM and CIUT-FM, stations operated by the students of Ryerson Polytechnical Institute and the University of Toronto, respectively. While all applications for student and community FM stations are examined on a case-by-case basis, it is the general policy of the Commission to licence only one student radio station in each official language in any given market.
In this case, the Commission has taken into account the applicant's statement that the proposed station will make use of a low-power unprotected frequency and that it "would be the only station in its service area that devotes considerable amounts of its music programming to black music and folk music from different parts of the world". Further, the Commission was impressed with the innovative community and educational programming proposals contained in this application and the numerous interventions in support, including those from the other local student FM licensees.
Based on the foregoing, the Commission is convinced that approval of the application for this alternative student FM station in Toronto will fill a need and add to the diversity and quality of programming currently available.
Furthermore, it notes that the applicant's proposal contains a number of commitments that reflect the Commission's objectives for student radio as outlined in Decision CRTC 75-247, including the use of volunteer staff and the high level and diversity of spoken word programming. In this regard, it expects the licensee to provide interested community groups and students from other post-secondary educational institutions within its coverage area access to its facilities.
The station will be operated in the "Group IV" music format, drawing most of its category 5 (Music-General) selections from the harder end of the pop and rock spectrum and featuring significant amounts of new, untried material and 16 hours per week of traditional and special interest music. A minimum of 30% of category 5 selections and 8% of category 6 (Music-Traditional and Special Interest) selections will be Canadian.
The Commission acknowledges the ambitious commitment to broadcast 65% of all programming in the foreground and mosaïc formats, with a minimum foreground level of 27% which will include a variety of specialized information, public affairs, arts and science magazine programs. The Commission also notes the licensee's commitment to broadcast two hours of French-language programming per week.
The Commission authorizes the licensee, as a condition of licence, to broadcast a maximum of 4 minutes per hour of restricted advertising, as defined in Public Notice CRTC 1983-43 and subsequently amended in Public Notice CRTC 1985-194.
It is a condition of this licence that construction of the undertaking be completed and that it be in operation within twelve months of the date of this decision or such further period as the Commission may, upon receipt of a request for extension before the expiry of the said twelve months, deem appropriate under the circumstances.
