Reconsideration of Decision CRTC 87-166
BRACEBRIDGE, Ontario
In accordance with Section 23 of the Broadcasting Act, the Commission hereby announces that it will reconsider and hear the matter set out in the third paragraph of Order in Council P.C. 1987-961. Following a Public Hearing held in the National Capital Region on 1 December 1986, the Commission, in Decision CRTC 87-166 dated 10 March 1987, approved the following:
a) the application by Telemedia communications Inc. and Muskoka-Parry Sound Broadcasting Limited, on behalf of a company to be incorporated (Telemedia-Muskoka Broadcasting) to operate an English-language FM station in Bracebridge, Ontario; and
b) the application by Muskoka-Parry Sound Broadcasting Limited (Muskoka Broadcasting) for an English-language FM radio network operation consisting of the new Bracebridge FM station and its FM undertaking in Huntsville.
The Commission also considered competing applications by Hugh and Michael Mackenzie, representing a company to be incorporated (the Mackenzies), for an FM licence to serve Bracebridge; and by Rogers Radio Broadcasting Limited (Rogers), for an English-language FM radio network that would think CHFI-FM Toronto with the new Bracebridge FM station proposed by the Mackenzies. These applications were denied by the Commission in Decision CRTC 87-166.
By Order in Council P.C. 1987-961, dated 8 May 1987, the Governor in Council referred back Decision CRTC 87-166 to the Commission for reconsideration and hearing.
The Order in Council states:
 "Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 87-166 on March 10, 1987 approving the application of Telemedia Communications Inc. and Muskoka-Parry Sound broadcasting Limited, on behalf of a company to be incorporated, for a licence to operate an English-language FM station in Bracebridge, Ontario and the application of Muskoka-Parry Sound Broadcasting Limited for a licence to operate an English-language FM radio network consisting of the new Bracebridge FM station and its FM station in Huntsville, Ontario;
 Whereas subsequent to the rendering of Decision CRTC 87-166 the Governor in council has received a petition requesting that the said Decision CRTC 87-166 be set aside and referred back to the Commission for reconsideration and hearing and a petition that it not be set aside or referred back to the Commission for reconsideration and hearing;
 Whereas the Governor in Council is of the opinion that it is material to the application for the issuance of the said licences that the Commission consider the representations of the local residents: and
 Whereas the Gobenor in Council is of the opinion that the Commission failed to consider adequately these representations in rendering Decision CRTC 87-166.
 Therefore, Her Excellency the Bovernor in Council, on the recommendation of the Minster of Communications, pursuant to section 23 of the Broadcasting Act, hereby refers Decision CRTC 87-166 of March 10, 1987 approving the applications for licences of Telemedia Communications Inc. and Muskoka-Parry Sound Broadcasting Limited, on behalf of a company to be incorporated, and of Muskoka-Parry Sound Broadcasting Limited back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission."
Filing of Comments
All interveners of record at the 1 December 1986 Public Hearing are invited to submit written comments on the matter set out in the third paragraph of the above-noted Order in Council.
Comments should be filed with the Commission and a copy served on all applicants by 8 July 1987.
The competing applicants (the Mackenzies and Rogers) may file written comments on the matter set out above, as well as written replies to any comments received. Such comments should be filed with the Commission, and a copy served on the commentator(s) and to Telemedia-Muskoka Broadcasting and to Muskoka Broadcasting by 31 July 1987.
Telemedia-Muskoka Broadcasting and Muskoka Broadcasting may file written replies with the Commission to any comments received. Copies of replies should be served on the commentator(s) no later than 21 August 1987.
All such comments and replies are to be received by 8 July, 31 July or 21 August 1987, as the case may be, by the Secretary General, CRTC, Ottawa, Ontario, K1A 0N2
