Pursuant to Public Notice CRTC 1986-320 dated 14 November 1986, the Commission approves, by condition of licence, the application to amend the licence for this Class 2 cable undertaking serving Revelstoke by authorizing the licensee to act as a Part III licensee.
In approving this application, the Commission has taken into account the fact that a previously authorized U.S. television signal was discontinued because of poor technical quality and that the licensee was subsequently authorized to distribute Canadian and U.S. signals received from the CANCOM network. It further notes that no other U.S. television station of adequate technical quality is available over-the-air. In view of the foregoing, the Commission has determined that this cable system should be regulated pursuant to Parts I and III of the Cable Television Regulations, 1986 (the regulations).
The Commission also approves the proposal by this licensee to avail itself of applicable sections of the regulations.
The Commission hereby amends the licence by deleting the existing provision and conditions of licence referred to in Appendix A to Public Notice CRTC 1986-184 dated 1 August 1986 entitled "Implementation Procedures Related to the New Cable Television Regulations" and by substituting the provision outlined in paragraph 1, and the conditions of licence outlined in paragraphs 2 and 3, as follows:
1. In addition to the services required or authorized to be distributed pursuant to the applicable sections of the Cable Television Regulations, 1986, the licensee is also authorized to distribute the services specified in the last renewal decision or, if there has been no renewal, in the initial licensing decision, and in any subsequent written approvals granted during the term of this licence.
2. The written approval of the Commission is required prior to any changes to the authorized service area.
3. The written approval of the Commission is required prior to the distribution of any service not authorized in the Cable Television Regulations, 1986 or in the last renewal decision or, if there has been no renewal, in the initial licensing decision.
The Commission also approves the application referred to in Appendix A to Public Notice CRTC 1986-184 to delete the authorization for the distribution of alphanumeric services and those services now authorized by section 24 of the regulations. Since the purpose of the application was to enable the licensee to avail itself of the authorizations set out in the regulations, this approval applies only to those television programming services listed in paragraphs 24(1)(a) to (h) and to those audio programming services not specifically exempted in paragraph 24(1)(i).
The Commission notes that the transfer of ownership conditions that are not dealt with in the regulations are not affected by this decision. The conditions that remain unchanged relate to the operation of the undertaking by the licensee itself and to the transfer or assignment of the licence.
