Pursuant to Public Notice CRTC 1986-314 dated 5 November 1986, the Commission approves the application to amend the broadcasting licence for CKWM-FM Kentville by deleting the condition of licence relating to the provision of the complete CBC English-language stereo network service and substituting therefor:
The licensee is required, until 31 August 1988, to provide 48 hours per week of CBC English-language stereo network programming.
The original condition of licence was imposed via Decision CRTC 86-811 dated 29 August 1986 following consideration of the licensee's application for licence renewal at a Public Hearing held in Hull, Quebec in June of this year. In the context of the earlier application, Annapolis Valley Radio Ltd. (AVR) proposed not to renew its affiliation agreement with the CBC. The CBC, however, in a written intervention and at the hearing, argued that AVR was contractually bound, for a period of two years ending 31 August 1988, to broadcast at least 50 hours per week of its English-language stereo network programming.
The Commission notes that the application approved herein is the result of an agreement concluded by AVR and the CBC subsequent to the release of Decision CRTC 86-811.
The Commission has taken into account the strong public interest in the availability of the full CBC stereo service in this area, as expressed in the fifteen interventions submitted with regard to this application. In this respect, the Commission considers that it is the CBC's responsibility to ensure that the complete FM stereo service is provided to all residents of the Annapolis Valley and expects it to study the means whereby such service may be implemented when the agreement between the CBC and the licensee expires.
The Commission notes that the complete CBC English-language stereo network service is authorized for distribution to cable subscribers in this area via the broadcasting receiving undertaking serving Kentville, Wolfville and areas, which is operated by Kings Kable Limited.
