PROPOSAL TO ENACT REGULATIONS TO IMPOSE FEES, LEVIES OR CHARGES
Bill C-4, An Act to Amend the Railway Act received Royal assent on 19 December 1986. This amendment empowers the Commission, for the purposes of recovering all or a portion of such costs as the Commission determines to be attributable to its responsibilities under the Railway Act, to make regulations imposing fees, levies or charges on any company within the meaning of section 320 of the Railway Act and providing for the manner of their calculation and payment. Under the amendment, the first regulation shall, if it so provides, have retroactive effect and be applicable to a company in respect of any period commencing after 31 March 1986.
The Commission proposes to enact regulations pursuant to this amendment. Specifically, the Commission proposes to calculate the fees to be paid by a company as a pro rata share based on gross revenues earned by the company from telecommunications services in the previous fiscal year. The Commission also proposes to specify in the regulations the manner of calculating the rate of interest payable by a company in respect of any overdue fees.
The Commission intends to provide that the regulation will be applicable in respect of the Commission's current fiscal year, which commenced 1 April 1986. It is estimated that the amount to be recovered for this period will be in the order of $6 million.
Procedure
1. Persons wishing to participate in this proceeding must notify the Commission of their intention
to do so by writing to the Secretary General, CRTC, Ottawa, Ontario, K1A 0N2, by 7 January
1987. The Commission will distribute a list of the parties and their mailing addresses.
2. Parties may file comments on the Commission's proposal by writing to the Commission,
serving copies on the other parties, by 23 January 1987.
3. Parties may file reply comments by writing to the Commission, serving copies on the other
parties, by 6 February 1987.
4. All documents referred to in this public notice are to be actually filed and served by the dates
mentioned, not merely mailed by those dates.
