ONTARIO REGION
Pursuant to Public Notice CRTC 1986-9 dated 10 January 1986, the Commission approves the applications to amend the licences for the broadcasting receiving undertakings listed in the appendix to this decision by distributing the signal of priority station CFMT-TV Toronto on a restricted channel. In accordance with Section 10(a) of the Cable Television Regulations, the Commission designates channel 5 or 9 for its distribution, as proposed by the licensees and as shown in the appendix to this decision.
The licensees have indicated that this exemption will enable them to add CFMT-TV to their basic service without disrupting existing priority services.
The Commission is satisfied that the signals provided will be of good quality and, therefore, considers that such distribution may be authorized. Should the quality of the CFMT-TV signal deteriorate significantly, the licensees will be expected to undertake immediate corrective action or to apply to the Commission to distribute the signal on another channel.
The Commission acknowledges the intervention from Multilingual Television (Toronto) Limited, licensee of CFMT-TV Toronto, concerning the uniform distribution of its signal on channel 4. In this regard, the Commission reminds the intervener that, consistent with the Commission's simplified procedures set out in its Public Announcement dated 4 December 1979, it expects licensees to choose channels with the public interest in mind and "to cooperate with television licensees in ensuring the carriage of Canadian signals on uniform channels, where practicable, throughout a given region". The Commission further notes that, in its intervention regarding the Newmarket and Oshawa systems, the intervener admitted that it has previously advised this licensee that it had no objection to the carriage of CFMT-TV on a restricted channel on the basic service.
The Commission also acknowledges the interventions from L.A. Perkin and B. Porter opposing the relocation of WGRZ-TV Buffalo, New York that would result from the addition of CFMT-TV to the basic service.
