Amendment to the Radio (F.M.) Broadcasting Regulations: Prescription of a New Class of FM Licence - The Experimental Class

In Public Notice CRTC 1984-233 entitled "Windsor Radio Review", following a review of the very exceptional broadcast market environment faced by Windsor radio stations, the Commission announced it was in the process of drafting amendments to the FM regulations that would allow it the regulatory flexibility to deal with special situations, such as Windsor, an experimental basis.
In Public Notice CRTC 1984-316, the Commission called for comments on proposed amendments to the Radio (F.M.) Broadcasting Regulations to establish a new class of FM licence, namely an experimental F.M. licence, in accordance with the schedule attached thereto.
The only submission received in response to Public Notice CRTC 1984-316 came from the Ontario Ministry of Transportation and Communications which welcomed the "introduction of a new experimental class of FM licence and the increased flexibility that this change represents."
On the recommendation of the Executive Committee, the Commission, on 28 February 1985, approved without any changes the proposed amendments to the Radio (F.M.) Broadcasting Regulations, which are set out in the schedule attached hereto. These amendments were registered on 1 March 1985 (SOR/85-220), and published in the Canada Gazette Part II on 20 March 1985.

SCHEDULE
1.(1) Subsection 3(1) of the Radio F.M. Broadcasting Regulations is revoked and the following substituted therefor:
"3.(1) The following six classes of F.M. licences are prescribed, namely, CBC F.M. licences, special F.M. licences, joint F.M. licences, first radio service F.M. licences, independent F.M. licences and experimental F.M. licences."
(2) Subsection 3(4) of the said Regulations is revoked and the following substituted therefor:
"(4) Every licence to operate an F.M. station, other than a CBC F.M. licence, a special F.M. licence or an experimental F.M. licence is a joint F.M. licence if, at the time the licence was issued or renewed, the person to whom the licence was issued or, in the case where that person is a corporation, that corporation or any corporation associated with that corporation, was licensed to operate an A.M. station in the same language in all or any part of the same market."
(3) Subsection 3(6) of the said Regulations is revoked and the following substituted therefor:
"(6) Every licence to operate an F.M. station, other than a CBC F.M. licence, a special F.M. licence, a joint F.M. licence, a first radio service F.M. licence or an experimental F.M. licence is an independent F.M. licence.
(6.1) Every licence to operate an F.M. station is an experimental F.M. licence if it is issued by the Commission to implement regulatory initiatives of an experimental nature for a limited period of time where the Commission has determined that, in view of the special social, cultural, economic or technological circumstances under which the station is to operate, it is in the public interest to do so in that it will further the objectives set out in section 3 of the Broadcasting Act."
