Proposed Amendment to the Radio (F.M.) Broadcasting Regulations
|
In Public Notice CRTC 1984-233 dated 25 September 1984 and entitled "Windsor Radio Review", the Commission acknowledged that a number of very special characteristics set Windsor from all other Canadian markets and warranted an exceptionally flexible regulatory approach, particularly with respect to the application of the FM policy.

An amendment to the Radio (F.M.) Broadcasting Regulations was enacted on 1 March 1985, prescribing a new class of FM licence, namely an experimental FM licence. The amendment, which will be published in a forthcoming Canada Gazette, is designed to allow the Commission the regulatory flexibility to deal with special situations, such as Windsor, on an experimental basis.

For similar reasons, the Commission now proposes a further amendment to the Radio (F.M.) Broadcasting Regulations, in accordance with the schedule attached hereto, which would exclude holders of experimental FM licences from the application of section 17 of the said regulations. Section 17 restricts the use of pre-recorded matter by FM stations.

All interested parties wishing to comment on the proposed amendment must send their submissions to the Secretary General, CRTC, Ottawa, Ontario, K1A 0N2, by 12 April 1985.

Radio (F.M.) Broadcasting Regulations, amendment
|
Section 4 and section 17 of the Radio (F.M.) Broadcasting Regulations are amended in accordance with the Schedule hereto.
|
SCHEDULE
|
1. Section 4 of the said Regulations is revoked and the following substituted therefor:
|
"4. These Regulations, other than sections 8, 15, 16, 17 and 19 which apply as specified therein, apply to all persons licensed to operate an F.M. station and to all matter broadcast by such stations."
|
2. That portion of section 17 of the Radio (F.M.) Broadcasting Regulations immediately preceding paragraph (a) thereof is revoked and the following substituted therefor:

"17. No holder of an F.M. licence, other than an experimental F.M. licence, shall, with a person who is not an employee of the licensee, enter into or renew a contract respecting the provision by that person for use by the F.M. station of pre-recorded matter intended primarily for broadcast unless"
