Following a Public Hearing in Hull, Quebec on 30 April 1985, the Commission renews the licence for the broadcasting receiving undertaking serving Hull, Aylmer and Gatineau from 1 October 1985 to 30 September 1990, subject to the conditions of licence specified in this decision and in the licence to be issued.
The boundaries of the authorized service area will be specified in the schedule which will be appended to the licence.
The licence is subject to the condition that the licensee own and operate, as a minimum, the local head-end, the amplifiers and the subscriber service drops, It is also subject to the condition that the licensee not charge more than the authorized maximum monthly subscriber fee of $8.80, including distant signal delivery costs, and maximum installation fee of $25.00.
In addition to the priority services required to be carried by regulation, the Commission renews the authority to carry the signals of the following optional stations: CFTM-TV, CBMT and CFCF-TV Montreal, CHRO-TV Pembroke, CKWS-TV Kingston, CICO-TV-24 Ottawa, Ontario, WNPI-TV (PBS) Norwood, WOKR (ABC), WROC-TV (NBC) and WHEC-TV (CBS) Rochester, New York; CJFM-FM, CFQR-FM, CHOM-FM, CKMF-FM, CBF-FM and CITE-FM Montreal, CKOI-FM Verdun, CIME-FM Saint-Adèle, CFGL-FM Laval, CIEL-FM Longueuil and CHGA-FM Maniwaki, Quebec and CHEQ-FM Smiths Falls, Ontario.
The Commission authorizes the licensee to continue the multiple distribution of the signal of WOKR Rochester on the augmented channel service for the duration of this licence. In accordance with paragraph 10(a) of the Cable Television Regulations, the Commission designates channel E(18) for such distribution.
The licensee is also authorized to continue to distribute French Television Programming (TVFQ-99), the CBC Parliamentary Television Network (both the television and the radio service), and programs originating from Intervision, the National Film Board and "Télé-Université" on special programming channels. Such authority will remain in effect only as long as no advertising material is included in these special programming services.
The licensee is authorized to exhibit the discretionary specialty network services distributed by The Sports Network, MuchMusic Network, Cable News Network, The Nashville Network, The Arts & Entertainment Network and the Financial News Network. Furthermore, the licensee is authorized to exhibit the discretionary pay television network services distributed by First Choice Canadian Communications Corporation (First Choice) and Premier Choix: TVEC Inc. Authority for the distribution of the audio stereo signals of the MuchMusic Network, First Choice and Premier Choix: TVEC Inc. will remain in effect only as long as the licensee adheres to the priorities outlined in the Commission's policy statements regarding the cable carriage of audio services (Public Notices CRTC 1984-124 and 1984-305).
It is a condition of licence that the licensee delete commercial messages from television signals received from broadcasting stations not licensed to serve Canada and substitute suitable replacement material in place of such messages upon receipt of notice in writing from the Commission.
The Commission notes that, following a commitment made by the licensee and noted in Decision CRTC 84-45 to redress the imbalance between the English and French-language FM services, the licensee is now carrying four additional French-language FM signals. The Commission encourages the licensee to complete the technical studies undertaken to determine if the two other signals authorized in the decision noted above, CIME-FM Sainte-Adèle and CBF-FM Montreal can be adequately received, and expects to be informed of the results of these studies.
The licensee was authorized in November 1984 to carry, on special programming channels, the programs of Télé-Université, and of Intervision and the National Film Board which were broadcast on the community channel. In its renewal application, the licensee explained that because of budgetary retraint, implementation of this authority had been delayed until September 1985. The Commission therefore requires that these programs be distributed on a special programming channel no later than 30 September 1985. Furthermore, it reminds the licensee that no advertising or sponsorship may be carried on the community channel or on these special programming channels.
The Commission further expects the licensee to submit a report within one year with respect to its commitment to acquire bi-directional transmission equipment for producing live remote broadcasts and the distribution of community programs to specific areas of the authorized territory.
As noted in Decision CRTC 84-45, the Commission encourages the licensee company to continue to have complete autonomy with regard to the management of the system and to reinvest funds, including most of the profits generated by the operation of this undertaking, in the licensee company.
