Pursuant to Public Notice CRTC 1985-19 dated 1 February 1985, the Commission renews the licence for the broadcasting receiving undertaking serving St. John's, Mount Pearl and surrounding area from 1 October 1985 to 30 September 1990, subject to the conditions of licence specified in this decision and in the licence to be issued.
The boundaries of the authorized service area will be specified in the schedule which will be appended to the licence.
The licence is subject to the condition that the licensee own and operate, as a minimum, the local head-end, the amplifiers and the subscriber service drops. It is also subject to the condition that the licensee not charge more than the authorized maximum monthly subscriber fee of $11.00, including distant signal delivery costs, and maximum installation fee of $25.00.
In addition to the priority services required to be carried by regulation, the licensee is authorized to continue to carry the signals of the following optional stations: WLBZ-TV (NBC) and WVII-TV (ABC) Bangor, Maine, received via microwave, WTVS (PBS) and WJBK-TV (CBS) Detroit, Michigan, received via satellite from the Canadian Satellite Communications Inc. (CANCOM) network.
The licensee is authorized to continue to distribute the CBC Parliamentary Television Network (English-language), Broadcast News, an automated weather and time service, Weather Radio Canada and educational programming. Such authority will remain in effect only as long as no advertising material is distributed on the channels used for the carriage of these special programming services.
The licensee is authorized to exhibit the discretionary specialty network services distributed by The Sports Network and the MuchMusic network. Furthermore, the licensee is authorized to exhibit the discretionary pay television network service distributed by First Choice Canadian Communications Corporation.
The licensee is authorized to continue to distribute pay television promotional material as a special programming service. Such authority will remain in effect only as long as the licensee adheres to the requirements set out in Decision CRTC 83-635 dated 1 August 1983.
The Commission commends the licensee for its continued interest in the development of community programming and, in particular, the involvement of diverse community groups.
It is also authorized to continue to distribute the programs of the Atlantic Satellite Network (ASN). This approval is subject to the condition that this service be distributed on an unimpaired channel of the music service and, in accordance with the terms of the agreement between ASN and Newfoundland Television Broadcasting Limited (NTV), that commercial messages which are likely to have a negative impact on NTV be deleted from the ASN service distributed in St. John's.
The Commission acknowledges the intervention from ASN expressing the view that the condition of approval noted above pertaining to the deletion of commercial messages from ASN's service should no longer apply. This issue will be reviewed with all parties concerned when the renewal application for ASN's licence, which expires on 30 September 1985, is considered.
It is a condition of licence that the licensee delete commercial messages from television signals received from broadcasting stations not licensed to serve Canada and substitute suitable replacement material in place of such messages upon receipt of notice in writing from the Commission.
