Following a Public Hearing in Regina on 19 June 1984 and Decision CRTC 84-807, the Commission renews the licences for the broadcasting receiving undertakings serving the communities noted above from 1 January 1985 to 30 September 1989. These licences will be subject to the conditions of licence specified in this decision and in the licences to be issued.

The boundaries of the authorized service areas will be specified in the schedules which will be appended to the licences.
|
|
The Commission acknowledges the licensee's intention to develop its community programming service further. The licensee indicated that it will examine the use of locally based micro-computers for community billboards where a low population or subscriber base negates the feasibility of introducing a character generator. The licensee also intends to implement regular training programs to encourage new groups and individuals to become involved in community programming. In this regard, the Commission acknowledges that community programming advisory boards have been established in 15 of the 26 locations, and notes their importance in motivating community participation.

The Commission notes that, at the present time, only one full-time programmer is employed by the licensee to be responsible for community programming for all locations, and that the 1983-84 budget allocation of approximately $25,000 does not provide for the expansion of facilitites nor the addition of the staff or facilities which may be required to develop an active and responsive community programming service. The licensee is encouraged to keep the Commission informed of its proposals to increase the usage of this facility.

In addition to the priority services required to be carried by regulation, the licensee is authorized to carry the optional stations indicated in Appendix I of this decision. Furthermore, in accordance with Decision CRTC 84-915, the licensee is also authorized to distribute the optional signals of WJBK-TV (CBS), WDIV (NBC) and WTVS (PBS) Detroit, Michigan and KOMO-TV (ABC) Seattle, Washington received via satellite from the Canadian Satellite Communications Inc. (CANCOM) network. The Commission notes, however, that the signal of KOMO-TV (ABC) Seattle is not yet available from CANCOM and therefore authorizes the licensee to continue to distribute, on an interim basis, the signal of WDAZ-TV (ABC) Devils Lake, North Dakota, using the distant head-end at Tolstoi, Manitoba, until such time as the licensee distributes KOMO-TV or applies, and is authorized for, the distribution of another ABC signal.

The Commission notes that in the case of Davidson, with the exception of WTVS (PBS), authority to distribute these signals was granted in Decision CRTC 83-964 dated 18 November 1983. The Commission reminds the licensee that, in accordance with Decision CRTC 84-915, it is required to add the carriage of at least one additional, suitable, authorized Canadian service prior to the distribution of the fourth U.S. signal from CANCOM at Grenfell, Kelvington, Lanigan, Lumsden, Melfort, Moosomin, Outlook, Tisdale and Whitewood; and at least two additional, suitable, authorized Canadian services prior to the distribution of third and fourth U.S. signals from CANCOM at Foam Lake, Hudson Bay, Preeceville, Wadena and Wynyard. Furthermore, with respect to Langenburg, the Commission is now satisfied that only one additional, suitable, authorized Canadian service must be added prior to the distribution of the fourth U.S. signal from CANCOM.

In its Carlyle and Oxbow applications, the licensee requested an exemption from the requirement that it distribute the signal of CBKFT-9 Bellegarde, which is a priority station at these locations, due to the low signal levels in these communities. The Commission is satisfied that an exception is warranted in these cases and therefore approves, as a condition of licence, that the signal of CBKFT-9 Bellegarde not be carried on the Carlyle and Oxbow systems. This authority will only be effective at such time as the licensee requests and receives authority for, and distributes, a replacement Canadian television service. In view of the fact that CBKFT-9 is the only over-the-air source of CBC French-language programming in this area, the Commission expects the licensee to examine the possiblity of distributing the signal of CBFT Montreal, which is available via satellite.

The licensee also requested exemption from the requirement that it distribute the signals of CBKFT Regina at Grenfell (erroneously shown in Notice of Public Hearing 1984-28 as CBKFT Bellegarde), CBKST-3 Leoville at Shellbrook and CBKFT-5 Zenon Park at Tisdale, which are priority signals at each respective location, due to the low signal levels in these communities. However, the Commission is not satisfied that all technical measures have been taken to receive these signals. The request for authorization to delete the carriage of these signals is, therefore, denied.

The licensee is authorized to exhibit the pay television service distributed by Allarcom Pay Television Limited at each location noted above, except Davidson and Shellbrook.
|
Further, it is a condition of licence that the licensee not charge more than the authorized maximum monthly subscriber fees indicated in Appendix II of this decision and maximum installation fee of $38.00. The Commission notes that, in accordance with Decision CRTC 84-915, the maximum monthly subscriber fee includes a CANCOM pass-through cost of $0.64 which may only be implemented on "a pro rata basis, of $0.16 per signal as each of the CANCOM services is made available to subscribers."

It is a condition of licence that the licensee own and operate the local head-end, signal modification and studio equipment, channel modulators, antennas and inside wiring portion of the subscriber service drops. The licensee is further reminded that all agreements entered into with Saskatchewan Telecommunications must comply fully with the Cable Television Regulations, the licensee's existing conditions of licence, and the terms of Public Notice CRTC 1983-82 related to pay television security equipment.

The Commission acknowledges the interventions by Messrs. John L. Stevenson, Robert D. Forster, Jerry L. Bell and R.D. Betker expressing dissatisfaction about the variety and quality of services offered in Carlyle. Mr. Robert Bandurka and five other Humboldt residents expressed similar concerns in their interventions. The Commission considers that the provision of the CANCOM 3+1 signals should alleviate these concerns.

Western Manitoba Broadcasters Limited submitted an intervention in which it points out that its station CKX-TV-1 Foxwarren is not distributed on the Langenburg and Moosomin undertakings. In its response, the licensee stated that it is already distributing three Canadian off-air television signals including the most recent addition, CKND-TV-2 Minnedosa, and that, in view of the limited number of subscribers and the direct capital investment required to purchase the necessary equipment, it is not financially viable at this time to carry this optional station.

Mr. Lloyd D. Ullrich also submitted an intervention in the form of a petition of 107 signatories from the City of Lanigan requesting the licensee to distribute the CTV and CBC Saskatoon signals in Lanigan. The licensee indicated in its reply that it will soon distribute CBKST Saskatoon (CBC), noting that carriage of the Saskatoon CTV signal is optional and that considerable capital investment would be required to distribute it. The Commission also notes that the licensee is authorized to distribute the signal of CICC-TV-1 (CTV) Wynyard.
