TELUS Communications Inc. – Tariff Notice 662 – Rate ratification for a tariff application

Application

  1. On 26 January 2024, the Commission received an application from TELUS Communications Inc. (TCI), Tariff Notice (TN) 662. The company proposed a change to item 5.12 of its Special Assembly Tariff, Service de location de voies intercirconscription.
  2. Specifically, TCI proposed the addition of a DS-1 circuit to a current customer’s agreement, for a total of three DS-1 circuits. The monthly rate for the additional circuit would be $3,200, the same as the monthly rate for the existing circuits.
  3. TCI submitted that, due to an administrative error, the new circuit was installed prior to the submission of TN 662, on 16 January 2024. TCI therefore requested that the Commission ratify the monthly rate for the third circuit for the period from 16 January 2024 to the effective date of the revised tariff pages.
  4. In Telecom Order 2024-36, the Commission approved TCI’s application on an interim basis, with an effective date of 14 February 2024. The Commission stated that it would address the ratification request in a subsequent order.
  5. In Telecom Order 2024-50, the Commission approved TCI’s application on a final basis. The ratification request was not addressed in that order.

Commission’s analysis 

  1. Pursuant to subsection 25(4) of the Telecommunications Act, the Commission may ratify the charging of a rate by a Canadian carrier otherwise than in accordance with a tariff approved by the Commission if the Commission is satisfied that the rate was charged because of an error or other circumstance that warrants the ratification.
  2. The Commission is satisfied that the premature installation of the additional circuit was due to an administrative error, and that the requested ratification is warranted.
  3. Accordingly, the Commission finds TCI’s request for rate ratification to be reasonable.

Conclusion

  1. In light of the above, the Commission ratifies the rate of $3,200 per month for the above-noted service for the period from 16 January 2024 to 14 February 2024, the date of interim approval of the application.
