Re: CRTC Public Hearing – 5 November 2013
Dear Sir:
Please refer to Notice of Consultation CRTC 2013-448-1 (the Notice), as well as to the Commission's letter dated 6 September 2013. Due to the instances of non-compliance identified in those documents, 3553230 Canada inc., licensee of CJMS, has been called to a public hearing to demonstrate why a mandatory order should not be issued requiring the licensee to comply with the Radio Regulations, 1986 (the Regulations). The Commission also intends to examine the possibility of suspending or revoking CJMS's licence as a result of the aforementioned non-compliance.
Please find attached a copy of the record of evidence gathered by Commission staff. The record contains:
- A copy of Broadcasting Notice of Consultation CRTC 2013-448-1;
- All decisions rendered and published by the Commission in relation to CJMS;
- A copy of the station's current licence;
- Evidence of the attempts by Commission staff to contact the licensee:
- Correspondence from Commission staff in its first attempt of obtaining copies of CJMS's logger tapes;
- Correspondence from Commission staff notifying the licensee of its non-compliance and calling it to the public hearing of 5 November 2013;
- FedEx's proof of delivery attesting that Claude Manny received the Commission's letter dated 4 July 2013.
The evidence on file includes all the documents used by the Commission to draw the conclusions set out in the Notice. These documents, as well as all the interventions received and evidence filed as part of the hearing, will be used by the Commission to render its final determination regarding CJMS's licence.
The licensee may provide comments or evidence to contest any incorrect facts set out on the record in question. It should be noted that your comments and supporting documentation must be filed with the Commission by 3 October 2013, and that this documentation will be placed on the public record and reviewed by the Commission.
