Various campus and community radio programming undertakings – Licence renewals

1. The Commission renews the broadcasting licences for the radio programming undertakings1 set out in Appendix 1 to this decision. The expiry dates for these licences are set out in that appendix. The licences will be subject to the conditions of licence set out in the appropriate appendices to this decision. The Commission received interventions in support of a number of the applications.

Non-compliance

2. In Broadcasting Information Bulletin 2011-347 (the Information Bulletin), the Commission announced a revised approach to dealing with radio stations found in non-compliance. The Commission noted in particular that each instance of non-compliance would be evaluated in light of factors such as the quantity, recurrence and seriousness of the non-compliance. The Commission also noted that it would consider the circumstances leading to the non-compliance in question, the licensee’s arguments and the measures taken to rectify the situation.

3. The Commission reminds licensees that they are solely responsible for ensuring compliance with all of their regulatory obligations and expects that they will take the necessary steps to bring themselves into compliance going forward.

4. The Commission has reviewed the public record and the reasons for which the licensees were in breach of the Radio Regulations, 1986 (the Regulations). In light of the information filed by the licensees, which provided context to the Commission’s preliminary findings, and in light of the factors outlined in the Information Bulletin, the Commission finds the licensees listed in Appendix 1 to be in non-compliance with section 9(2) of the Regulations in the manner described in Broadcasting Notice of Consultation 2012-460.2 Consequently, with the exception of CIEU-FM Carleton and CFBO-FM Moncton, as described below, the Commission finds it appropriate to grant these undertakings short-term licence renewals. The Commission notes that these short-term renewals will allow for an earlier review of the licensees’ compliance with the Regulations and their conditions of licence.

5. With respect to the licensees that failed to file annual returns for certain broadcast years, the Commission notes that it has imposed conditions of licence requiring them to file these missing returns by no later than 8 May 2013.

Terms and conditions of licence for the campus radio programming undertaking CIOI-FM Hamilton, Ontario

Terms

The licence will expire 31 August 2018.

Conditions of licence

1. The licensee shall adhere to the conditions set out in Standard conditions of licence for campus and community radio stations, Broadcasting Regulatory Policy CRTC 2012-304, 22 May 2012.

2. The licensee shall retain full control over all decisions concerning the management and programming of this station and representatives of the student body, faculty, alumni or administration representatives of the university or college with which the station is associated, considered together, shall form the majority of the board of directors. In accordance with the requirements of the Direction to the CRTC (Ineligibility of Non-Canadians), P.C. 1997-486, 8 April 1997, as amended by P.C. 1998-1268, 15 July 1998, the chief executive officer and not less than 80 per cent of the members of the board of directors must be Canadians ordinarily residing in Canada.

 

Appendix 4 to Broadcasting Decision CRTC 2012-704

2. Terms

Conditions of licence

1. The licensee shall adhere to the conditions set out in Standard conditions of licence for campus and community radio stations, Broadcasting Regulatory Policy CRTC 2012-304, 22 May 2012.

2. The licensee is authorized to use a Subsidiary Communications Multiplex Operations (SCMO) channel to broadcast predominantly Punjabi- and Hindi-language programming.

3. The licensee is authorized to use a Subsidiary Communications Multiplex Operations (SCMO) channel to broadcast predominantly Korean-language radio service.

4. The licensee shall file its annual return for the 2009-2010 broadcast year by no later than 8 May 2013.

Terms, conditions of licence and origins of the cultural groups to be served for the community radio programming undertaking CHHA Toronto, Ontario

Terms

The licence will expire 31 August 2018.

Conditions of licence

1. The licensee shall adhere to the conditions set out in Standard conditions of licence for campus and community radio stations, Broadcasting Regulatory Policy CRTC 2012-304, 22 May 2012.

2. The licensee shall devote 100% of the programming broadcast in each broadcast week to ethnic programs, as defined in the Radio Regulations, 1986, as amended from time to time.

3. The licensee shall devote a minimum of 75% of the programming broadcast in each broadcast week to third-language programs, as defined in the Radio Regulations, 1986, as amended from time to time.

4. The licensee shall devote a minimum of 60% of the ethnic programs broadcast in each broadcast week to Spanish-language programs, targeting the many cultural groups within the Spanish-speaking community.

5. The licensee shall broadcast, in each broadcast week, ethnic programs directed to a minimum of 4 cultural groups in at least 4 different languages.

Where the licensee broadcasts religious programming as defined in Religious Broadcasting Policy, Public Notice CRTC 1993-78, 3 June 1993, the licensee shall adhere to the guidelines set out in sections III.B.2.a) and IV of that public notice with respect to the provision of balance and ethics in religious programming, as amended from time to time.

[1]The original expiry date for these undertakings was 31 August 2011. The broadcasting licences were administratively renewed until 31 December 2012 as a result of Broadcasting Decisions 2011-558, 2011-790 and 2012-456.

[2] In Broadcasting Notice of Consultation 2012-460, the Commission identified CJEU Gatineau as being in non-compliance with section 9(2) of the Regulations for the 2009-2010 broadcast year. However, since the station was in a testing phase at that time, CJEU was not required to submit an annual return covering that period. As a result, CJEU is deemed to be in compliance with the Regulations and is consequently renewed along with the campus and community radio undertakings found to be in compliance with the Regulations and their conditions of licence in Broadcasting Decision 2012-683.
