Re:  Bulk Porting of Telephone Numbers Acquired by Distributel

In a letter dated 14 December 2009, Distributel Communications Limited (Distributel) requested that the Commission direct Rogers Cable Communications Inc. (Rogers) to permit the bulk porting of telephone numbers used by end users that Distributel acquired in conjunction with its acquisition of Cybersurf Corp.’s (Cybersurf) assets. Distributel stated that Cybersurf had obtained these telephone numbers from a reseller who had, in turn, obtained them from Rogers.

On 15 December 2009, Commission staff received a letter from Goodmans LLP, on behalf of Comwave Telecom Inc. (Comwave) requested that all parties, including itself, be given an opportunity to make submissions prior to the Commission making a ruling in the matter.

In the circumstances, Commission staff agree that a process to allow for the making of submissions is appropriate on the issue of the bulk porting of telephone numbers from the Rogers CLEC network to Distributel’s CLEC network for customers acquired by Distributel from Cybersurf Corp.

By 31 December 2009, Distributel is to serve a copy of its letter of 14 December 2009 on Comwave and Cybersurf.

By 15 January 2010, the above-noted parties are to file with the Commission, serving a copy on each other, their submissions on this matter.

By 22 January 2010, the parties may file with the Commission, serving a copy on each other, their reply to the submissions by other parties.

By 27 January 2010, Distributel may file with the Commission, serving a copy on the other parties final comments on this matter.

Where a document is to be filed or served by a specific date, the document must be actually received, not merely sent, by that date.
