Re: Telecom Decision CRTC 2008-1 - Filing of follow-up information
Following a Supreme Court of Canada decision dismissing appeals related to Use of deferral account funds to improve access to telecommunications services for persons with disabilities and to expand broadband services to rural and remote communities, Telecom Decision CRTC 2008-1 (Telecom Decision 2008-1), Commission staff on 25 September 2009, issued correspondence to interested parties to recommence a proceeding related to certain supplemental communities under consideration for funding for broadband expansion. In Telecom Decision 2008-1 the Commission determined that additional information was necessary in order to have a full record on which to base its final decision regarding these supplemental communities proposed by Bell Aliant Regional Communications, Limited Partnership and Bell Canada (the Bell companies) for broadband expansion that were not approved in Telecom Decision 2008-1.
The Bell companies filed responses to interrogatories related to the supplemental communities in correspondence dated 16 October 2009. This correspondence included maps of the areas around these communities that the Bell companies propose to serve.
These supplemental communities include the following:
Ontario Campbellford Casselman Delhi
Harriston Hastings Hepworth
Lanark Maxville Michigan
Tweed Wingham
Quebec La Patrie Napierville Yamaska
Alternate providers of broadband service (ABSPs) were required to request exclusion from the Bell companies broadband expansion plans for any of the supplemental communities by 6 November 2009, consistent with the guidelines for such exclusion as provided in Telecom Decision 2008-1 and outlined in the Commission’s letter dated 17 January 2008.
On 20 November 2009, the Commission received a request from Bragg Communications Inc. (Bragg), on behalf of its wholly-owned subsidiaries Persona Communications Inc. and Amtelecom Telco GP Inc., in which Bragg requested an extension for the filing of the information outlined in the 17 January 2008 letter.
Commission staff is of the view that an extension is warranted in this case. Accordingly, the deadline for ABSPs to file the information outlined in the 17 January 2008 letter with respect to the above-noted supplemental communities is extended from 6 November 2009 to 27 November 2009. The Bell companies may reply to the ABSPs’ comments by 8 December 2009. ABSPs may reply to the Bell companies’ comments by 15 December 2009.
