Re: Part VII application by Shaw Cablesystems Limited (Shaw) seeking an order directing TELUS Communications Company (TCC) to provide Support Structure Service in various British Columbia Communities

On 22 April 2009, the Commission sent out an Organization and Conduct letter to Shaw and TCC, which informed the parties that the Commission would hold an oral public hearing on Monday, June 1, 2009 at 10am (Eastern Daylight Time) to adjudicate, in accordance with the expedited process established in Broadcasting and Telecom Information Bulletin CRTC 2009-38, the dispute between Shaw and TCC regarding Shaw’s access to TCC support structures in the Acquired Systems.

On 23 April 2009, TCC requested clarification with regard to the filing requirements of documents for the record of this proceeding. Specifically, TCC requested whether if a party wished to rely on a previously filed document, it must include a copy of the document in question with its May 7 filing and could not simply refer to or quote from the previously filed document.  TCC also sought clarification as to whether Commission determinations, tariffs, tariff filings, and other documentation published by the Commission needed to be filed by a party wishing to rely on them.

To assist the parties, the following clarifications are provided:

1) To the extent that a document is already on the record of the proceeding, a party need not specifically include it as part of its 7 May 2009 filing but, if wishing to rely on it, must identify it.

2) Documentation such as Commission determinations need not be filed. In this respect, it is noted that there was an error in the Commission’s Organization and Conduct letter dated 22 April 2009, which is corrected by way of this letter.
