CHLT-FM Sherbrooke - Technical change

  The Commission approves the application by 591991 B.C. Ltd., a subsidiary of Corus Entertainment Inc., to amend the broadcasting licence for the commercial radio programming undertaking CHLT-FM Sherbrooke, in order to change the frequency and to change the authorized contours.
 

Introduction

1. The Commission received an application by 591991 B.C. Ltd., a subsidiary of Corus Entertainment Inc., to amend the broadcasting licence for the commercial radio programming undertaking CHLT-FM Sherbrooke, in order to change the frequency from 102.1 MHz (channel 271B) to 107.7 MHz (channel 299C1) and to change the authorized contours by increasing the average effective radiated power (ERP) from 5,800 watts to 24,000 watts, increasing the effective antenna height and relocating the transmitter.
2. The licensee indicated that the purpose of the changes was to improve the station's signal, which it finds inadequate, and to improve its coverage in the Sherbrooke market and surrounding areas.
3. The Commission received several interventions opposing the application, a number of comments and some interventions supporting the application. The public record of this proceeding is available on the Commission's Web site at www.crtc.gc.ca under "Public Proceedings."
 

Commission's analysis and determination

4. Most of the interveners opposing the application and a number of the individuals who filed comments are concerned that, if the Commission approved the present application, it would be virtually impossible to tune in to Vermont Public Radio (VPR), which operates at 107.9 MHz, without interference.
5. Most interveners opposing the application submitted that the loss of VPR would leave them with only one English-language station in the Sherbrooke area, i.e., the Canadian Broadcasting Corporation.
6. In its comments, Astral Media Radio Inc. (Astral) noted that, if the Commission approved the present application, the new frequency of CHLT-FM Sherbrooke (107.7 MHz) would be the fourth adjacent frequency to CIMO-FM-1 Sherbrooke (106.9 MHz) and would create an area of interference near the new transmitter site at Mont Bellevue, which, in turn, would compromise reception of CIMO-FM Magog's signal in Sherbrooke itself.
7. In its response, the applicant noted that its new technical parameters would be in compliance with all domestic and international requirements in place to protect the quality of the signal of U.S. station VPR. The applicant further noted that it would be prepared to work with Astral to share the Mont Bellevue site and thus prevent any interference between their respective stations.
8. The Commission notes that because VPR is a U.S. station, it was not considered in the examination of this application.
9. Furthermore, the Commission is satisfied that the change in technical parameters as proposed by the applicant will provide listeners in Sherbrooke with a better quality signal.
10. In light of the above, the Commission approves the application by 591991 B.C. Ltd., a subsidiary of Corus Entertainment Inc., to amend the broadcasting licence for CHLT-FM Sherbrooke, in order to change the frequency from 102.1 MHz (channel 271B) to 107.7 MHz (channel 299C1) and to change the authorized contours by increasing the average ERP from 5,800 watts to 24,000 watts, increasing the effective antenna height and relocating the transmitter.
11. The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.
12. The Commission reminds the licensee that pursuant to section 22(1) of the Broadcasting Act, this authority will only be effective when the Department notifies the Commission that its technical requirements have been met and that a broadcasting certificate will be issued.
