PREAMBLE
Items 1 to 18
On 12 March 2007, the Commission issued Broadcasting Public Notice CRTC 2007-24, calling for applications for a broadcasting licence to carry on a radio programming undertaking to serve Owen Sound, Ontario.
On 8 June 2007, the Commission issued Broadcasting Public Notice CRTC 2007-61, and on 13 June 2007 issued Broadcasting Public Notice 2007-61-1, calling for applications for a broadcasting licence to carry on a radio programming undertaking to serve Windsor, Ontario.
On 22 June 2007, the Commission issued Broadcasting Public Notice CRTC 2007-67, calling for applications for a broadcasting licence to carry on a radio programming undertaking to serve Peterborough, Ontario.
In response to these calls, the Commission has received a number of applications for licences to serve these markets.
Some of these applications are technically mutually exclusive. These applications are:

For Owen Sound

Items 1 to 4 are technically mutually exclusive proposing the use of the frequency 92.3 MHz.

These applications will be treated as competitive radio applications for Owen Sound.

For Windsor

Items 5 and 6 are technically mutually exclusive proposing the use of the frequency 95.9 MHz.

These applications, along with items 7 and 8 will be treated as competitive radio applications for Windsor.

For Peterborough

Items 9 to 16 are technically mutually exclusive proposing the use of the frequency 96.7 MHz.

In addition, items 17 and 18 propose new commercial radio services for Kawartha Lakes that are also technically mutually exclusive for the use of the frequency 96.7 MHz. While these applications were not submitted in response to Broadcasting Public Notice CRTC 2007-67, the proximity of Kawartha Lakes to Peterborough and their proposed use of 96.7 MHz render these applications technically mutually exclusive with items 9 to 16. Accordingly, items 17 and 18 will be scheduled as part of the competitive phase at the hearing where the Commission will consider the Peterborough new radio applications.

The Commission intends to consider, subject to interventions, items 19 to 38 during the non-appearance phase of the public hearing.

  The licensee advised that a "nested" FM solution is the best means to improve the access to CBE and enhance the quality of service to Windsor-area listeners, especially those in Windsor's downtown core. In addition, it noted that half of the potential listener base has been lost to the Detroit market and half of what remains does not listen to AM at all.

  The applicant proposes to maintain CKRU's current Oldies music format on the proposed FM station.
  The applicant is also requesting approval to operate under the condition of licence set out in Public Notice CRTC 1998-132 allowing it to broadcast a minimum level of 30% Canadian content in any broadcast week where at least 90% of musical selections from content category 2 that it broadcasts are selections released before 1 January 1981.
  The applicant is requesting permission to simulcast the programming of the new FM station on CKRU for a period of three months from the date of implementation of the new station.
  The applicant is also requesting, pursuant to sections 9(1)(e) and 24(1) of the Broadcasting Act, the revocation of the licence of CKRU effective at the end of the simulcast period.

  The licensee states that CFOS suffers from serious day-time signal deficiencies in its main market of Owen Sound from October to March. This transmitter will fill in the coverage gaps to the area as well as in the Grey Bruce Region of Ontario.
