Re: CLEC rates for interconnection

In Saskatchewan Telecommunications - Line-side wireless access service rates , Telecom Decision CRTC 2006-19, 13 April 2006 , the Commission approved, on a final basis, rates for Saskatchewan Telecommunications' (SaskTel's) line-side wireless access service.   Further, the Commission determined that SaskTel's line-side wireless access rates were to take effect on 1 June 2002 .

In Aliant Telecom, Bell Canada , MTS Allstream, Sasktel and TCI - Approval of rates on a final basis for Access Tandem service , Telecom Decision CRTC 2006-22, 27 April 2006 , the Commission approved, on a final basis, Access Tandem (AT) rates for the incumbent local exchange carriers (ILECs).   Further, the Commission determined that AT rates were to take effect on 1 June 2002 .

In Aliant Telecom, Bell Canada , MTS Allstream, Sasktel and TCI - Approval of rates on a final basis for Direct Connection service , Telecom Decision CRTC 2006-23, 27 April 2006 , the Commission approved, on a final basis, Direct Connection (DC) rates for the ILECs.   Further, the Commission determined that DC rates were to take effect on 17 December 2003 .

In Local Competition , Telecom Decision CRTC 97-8, 1 May 1997 , the Commission considered that it was in the public interest to require competitive local exchange carriers (CLECs) to provide interconnection for wireless service providers and equal access for all interexchange service providers, at terms and conditions equivalent to those contained in the ILECs' tariffs. The Commission required all CLECs to file proposed tariffs for interconnection and to justify any departure from the terms and conditions contained in the ILECs' tariffs.

In Regulatory framework for second price cap period , Telecom Decision CRTC 2002-34, 30 May 2002, the Commission directed each ILEC to issue tariff pages by 1 June of each year incorporating adjustments to Category I Competitor Service rates to reflect the application of a constraint equivalent to the rate of inflation less a productivity factor. Pursuant to this decision, the ILECs issued tariff pages effective 1 June 2006 , reducing these rates.

Accordingly, CLECs are required to file within 30 days of the date of this letter, proposed tariffs, effective on the dates indicated above, to reflect the ILECs interconnection rates or to file proposed rates with cost justification for any departures from the ILECs' interconnection rates.   To assist CLECs with their required filings, it is noted that revised interconnection rates, by province, can be found on the CRTC website as part of the CLEC Model Tariff Version 26.

Moreover, CLECs are required to evaluate the requirements for rebates going forward from the effective dates indicated above, based upon the differences between the final rates approved by the Commission and the rates charged to customers in any price cap year, and to issue those rebates to customers.   To assist CLECs with this process, tables setting out the applicable rates for each price cap year can be found in Appendices to this letter.
