Native FM radio station in Rouyn-Noranda

 

 

In this decision, the Commission approves an application by Radio communautaire MF Lac Simon inc. to operate a French-, Anishnabe- and Algonquin-language Native Type B FM radio station in Rouyn-Noranda.
 

The application

1. The Commission received an application by Radio communautaire MF Lac Simon inc. for a broadcasting licence to operate a French-, Anishnabe- and Algonquin-language Native Type B FM radio programming undertaking in Rouyn-Noranda. The applicant proposed to operate the station at 98.3 MHz (channel 252A) with an effective radiated power of 490 watts.
2. The Commission notes that the applicant is a not-for-profit organization whose structure provides for membership, management, operation and programming by members of the community at large. Its board of directors must represent the community being served and will be ultimately responsible for ensuring that the licensee adheres to the Radio Regulations, 1986 and the station's conditions of licence.
 

Programming

3. The applicant indicated that, in each broadcast week, the new station would broadcast 126 hours of programming. It proposed to devote at least 50% of each broadcast week to programming in Aboriginal languages.
4. The proposed station would broadcast a maximum of 51 hours, in any broadcast week, of programming that is not produced by the station. The originating station would be Native radio station CHUT-FM Lac Simon.
5. The new station would offer a format consisting of country music and musical selections from Aboriginal artists.
6. The applicant plans to expose and promote, and to preserve the use of, the native language of the Anishnabe First Nation. Educational programming (in French, Anishnabe and Algonquin) will also be developed for Anishnabe/Algonquin residents of the Regional County Municipality of Rouyn-Noranda.
 

Canadian talent development

7. The proposed station would provide a forum for Aboriginal artists from Quebec and the rest of Canada. It would also provide First Nations people with the opportunity to express themselves through a promotional concept designed for and by them. The applicant added that the station would dedicate itself to the promotion of local Aboriginal artists and that it intended to ensure that at least 10% of all musical selections would be performed or composed by Aboriginal artists.
 

Intervention

8. The Commission received one intervention in support of this application.
 

The Commission's determination

9. The Commission is satisfied that the programming service proposed by the applicant is consistent with the objectives of the Broadcasting Act and, in particular, with section 3(1)(o) concerning programming that reflects Canada's Aboriginal cultures.
10. Accordingly, the Commission approves the application for a broadcasting licence to operate a French-, Anishnabe- and Algonquin-language Native Type B FM radio station in Rouyn-Noranda at 98.3 MHz (channel 252A) with an effective radiated power of 490 watts.
11. The approval of this application reflects Changes to conditions of licence for certain native radio undertakings, Public Notice CRTC 2001-70, 15 June 2001. As indicated in the notice, the Commission no longer imposes limits on the advertising broadcast by Native radio stations and networks. However, the Commission requires that they broadcast a Canadian content level of at least 35% for category 2 (Popular) music. A condition of licence in this regard is set out in the appendix.
12. The Commission notes the applicant's commitment to devote at least 50% of each broadcast week to programming in Aboriginal languages and encourages it to exceed this amount.
 

Issuance of the licence

13. Consistent with the Commission's Native Broadcasting Policy, Public Notice CRTC 1990-89, 20 September 1990, the licence will be for a Native Type B FM radio station. The licence will expire 31 August 2010 and will be subject to the conditions set out in the appendix to this decision.
14. The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.
15. The Commission reminds the applicant that, pursuant to subsection 22(1) of the Broadcasting Act, no licence may be issued until the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.
16. Furthermore, the licence for this undertaking will be issued once the applicant has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and, in any event, no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 19 March 2006. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before this date.

Appendix to Broadcasting Decision CRTC 2004-128

 

Conditions of licence

 

1. The licensee shall ensure that, in each broadcast week, a minimum of 35% of all musical selections from category 2 (Popular Music) will be devoted to Canadian selections played in their entirety.

 

2. The licensee shall adhere to the guidelines on gender portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-role portrayal code for television and radio programming, as amended from time to time and approved by the Commission.

 

3. The licensee shall adhere to the provisions of the CAB's Broadcast code for advertising to children, as amended from time to time and approved by the Commission.
