Native FM radio station in Wahta Mohawk Territory

1.

The Commission approves the application by Matthew Commandant, on behalf of a non-profit organization to be incorporated as Wahta Communications Society, for a broadcasting licence to operate an English-language Native Type B FM radio programming undertaking in Wahta Mohawk Territory near Bala, Ontario.

The new station will broadcast 126 hours of local programming during each broadcast week, including 7 hours of station-produced programming in the Mohawk language, and 110 hours of musical programming, of which 40 hours will be Aboriginal music. The applicant stated that 25% of the music broadcast will be performed or composed by Aboriginal artists.

The applicant plans to address the specific needs and concerns of the native population by focusing on language education with instructional programs as well as "word of the day" features. The applicant also proposes to invite elders to relate their experiences in on-air features, thus preserving oral traditions.

The station will hold a series of musical concerts providing exposure for local performers. These concerts will be taped for future broadcasts and shared with other Aboriginal radio stations. Through fundraising activities, the applicant plans to purchase studio recording time for use by local native artists.

The applicant proposes to broadcast 7 hours of cultural programming originating from CFJB-FM Barrie and CHRZ-FM Parry Sound.

The station will operate at 98.3 MHz (channel 252A) with an effective radiated power of 1,060 watts.

The Commission did not receive any interventions in connection with this application.

The Commission requires that native radio programming undertakings and networks broadcast a Canadian content level of at least 35% for category 2 music. A condition of licence to this effect is set out in the appendix to this decision.

The Commission encourages native radio stations that wish to broadcast wrap-around programming after their daily sign-off, to use programming from another native radio station or network.

Consistent with the Commission's Native Broadcasting Policy, Public Notice CRTC 1990-89, 20 September 1990, the licence will be for a Type B Native FM radio programming undertaking. The licence will expire 31 August 2009 and will be subject to the conditions specified therein as well as to the conditions set out in the appendix to this decision.

The Department of Industry (the Department) has advised the Commission that, while this application is conditionally technically acceptable, it will only issue a broadcasting certificate when it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

The Commission reminds the applicant that, pursuant to section 22(1) of the Broadcasting Act, no licence may be issued until the Department notifies the Commission that its technical requirements have been met, and that a broadcasting certificate will be issued.

13.

Furthermore, the licence for this undertaking will be issued once the applicant has satisfied the Commission, with supporting documentation, that the following requirements have been met:
  • an eligible Canadian corporation has been incorporated in accordance with the application in all material respects;
  • the applicant has informed the Commission in writing that it is prepared to commence operations. The undertaking must be operational at the earliest possible date and in any event no later than 24 months from the date of this decision, unless a request for an extension of time is approved by the Commission before 1 May 2005. In order to ensure that such a request is processed in a timely manner, it should be submitted at least 60 days before this date.

Appendix to Broadcasting Decision CRTC 2003-137

Conditions of licence

  The licence will be subject to the conditions specified therein and to the following conditions of licence.
  1. The licensee shall devote a minimum of 35% of all musical selections from Category 2 - Popular music, each broadcast week, to Canadian selections.
  2. The licensee shall adhere to the guidelines on gender portrayal set out in the Canadian Association of Broadcasters' (CAB) Sex-role portrayal code for television and radio programming, as amended from time to time and approved by the Commission.
  3. The licensee shall adhere to the provisions of the CAB's Broadcast code for advertising to children, as amended from time to time and approved by the Commission.
