  Applicants are reminded that the Public Hearing will follow the standard four-phase competitive process.
  In Public Notice CRTC 2001-39 (22 March 2001) the Commission called for applications for broadcasting licences "to provide AM and/or FM radio programming services that clearly reflect the diversity of languages, as well as the multicultural and multi-ethnic reality of the Greater Toronto Area (GTA)." This call followed a recommendation contained in a CRTC report to the Governor in Council on measures to ensure that the residents of the GTA receive a range of radio services reflective of the diversity of their languages and cultures (Public Notice CRTC 2001-10).
  On 15 May 2001 the Commission suspended the deadline for filing applications, pending Industry Canada's evaluation of measures aimed at expanding the radio spectrum's capacity to accommodate additional programming services in the GTA (Public Notice CRTC 2001-39-1). The suspension was prolonged on 23 August 2001 (Public Notice CRTC 2001-39-2).
  Early in 2002 Industry Canada indicated that some relaxation of the technical rules was planned. This would result in the allocation of one more FM channel to the area, and the department announced that it would be prepared to entertain applications under the existing technical rules or the new ones that would soon come into effect. Therefore, on 12 February 2002, the Commission reactivated the call (Public Notice CRTC 2001-39-3), and clarified on 4 March that the call included transitional digital radio services (Public Notice CRTC 2001-39-4).
  17 applications to serve the GTA filed by 15 parties will be considered at this hearing. The majority of these applications propose the use of the same frequency and are, therefore, technically mutually exclusive. All will be treated as competitive radio applications for the Toronto market.
  The Commission has released population, economic, and licensing data pertaining to the Toronto Census Market Area (CMA), with a particular focus on the ethnic radio sector. A public file has been created where interested parties may view the report.

  Items 7, 8 and 9 relate to applications filed by Radio 1540 Limited in response to Public Notice CRTC 2001-39 that, in part, are technically mutually exclusive. The applicant is the licensee of Toronto radio stations CHIN-AM (and CHIN-FM-1) and CHIN-FM.
  The following sets out each of the three applications.

  Application by RADIO 1540 LIMITED for a licence to operate a commercial Specialty FM (ethnic radio) station in Toronto by converting CHIN-AM from the AM to the FM band.
  The new station would operate on frequency 101.3 MHz (channel 267A) with an effective radiated power of 90 watts.
  By condition of licence, the applicant proposes to direct ethnic programming to a minimum of 23 cultural groups in a minimum of 17 different languages per broadcast week.
  CHIN-AM's service is currently retransmitted by CHIN-FM-1's operation on the 101.3 MHz frequency. This serves to augment the incomplete daytime-only coverage of CHIN-AM. Based on its existing technical parameters, the 101.3 MHz frequency has been identified by Industry Canada as one of the available FM frequencies in the Toronto area. Owing to the potential loss of the 101.3 MHz frequency by Radio 1540 Limited, the proposed new FM would ensure for the continued day and night service of CHIN-AM.
  The applicant has indicated that should this application by approved then it will not proceed with application 2002-0261-4 involving the amendment of CHIN-AM's licence related to its operation of CHIN-FM on the 91.9 MHz frequency.
  Applications 2002-0273-9 (new FM, flip of CHIN-AM) and 2002-0260-7 (new FM) are technically mutually exclusive. The applicant has stated that it assigns the highest priority to its new FM application.

  The licensee proposes to change the frequency of its CHIN-FM-1 transmitter from 101.3 MHz (channel 267LP) to 91.9 MHz (channel 220A1) and to increasethe effective radiated power from 22 to 35 watts.
  CHIN-FM-1 will continue to transmit the signal of CHIN-AM including directing ethnic programming to a minimum of 23 cultural groups in a minimum of 17 different languages per broadcast week.
  Based on its existing technical parameters, the 101.3 MHz frequency currently occupied by the applicant has been identified by Industry Canada as one of the available FM frequencies in the Toronto area. Owing to the potential loss of the frequency 101.3 MHz by Radio 1540 Limited, these proposed technical changes would ensure the continued operation of CHIN-FM-1.
  The applicant has indicated that it will not proceed with this application if it is granted approval for application 2002-0273-9 (new FM, flip of CHIN-AM).

  The applicant is requesting an exemption from Section 7(2) of the Radio Regulations, 1986 that requires an ethnic licensee to devote not less than 50% of the broadcast week to third-language programs. In this regard a maximum of 79% of the programming to be broadcast would be English-language ethnic programming.
