New low-power tourist information service

  The Commission approves the application for a new low-power English-language FM radio station at Timmins. The terms and conditions of licence are set out in the appendix to this decision.
1. The applicant, who operates a similar service in North Bay, proposes a tourist information service consisting of pre-recorded welcome messages, paid advertising and general information relating to the tourist sites and events in and around the city of Timmins. The service will operate on a year-round basis.
2. Programming will consist of a one-hour pre-recorded announcements package repeated continuously over a 24-hour period, 7 days a week. It will include 3 minute segments describing local attractions, tips for the traveler, information relating to tourists sites and events, a program entitled "Destination Timmins" as well as a 2-minute program entitled "Timmins This Week", repeated every 15 minutes, to inform tourists about plays, fairs, hockey games, races and points of interest in the area. As well, programming will include a maximum of 10 hours per week of "live" broadcasting.
3. The "live" segment will not include conventional news or sports event coverage but could include coverage of local parades, tournaments, firework displays and updates on motel occupancy, road conditions and gas prices.
4. In its licensing policy for low-power radio broadcasting undertakings, the Commission indicated that the licences for these undertakings would be subject to conditions that would define programming so as to ensure that licensees do not begin to offer the same service as a conventional licensee, without prior Commission approval (PN 1993-95). These conditions are set out in the appendix to this decision.
5. The Commission acknowledges the interventions received with respect to this application and is satisfied with the licensee's reply.

Appendix to Decision CRTC 2001-51

 

Terms of licence for the low-power FM radio programming undertaking at Timmins

  The Commission will only issue the licence, and it will only be effective at such time as:
 

· the licensee confirms in writing that it is ready to begin operation. This must take place within 12 months of today's date. Any request for an extension to that deadline requires Commission approval and must be made in writing within that period.

 

· the Department of Industry, having advised that the application is conditionally technically acceptable, has determined that there is no unacceptable interference with NAV/COM services and indicated that it will issue a broadcasting certificate (section 22(1) of the Broadcasting Act).

  The licence, when issued, will expire 31 August 2007.
  As proposed, the station will operate on the frequency 94.3 MHz, channel 232LP, with an effective radiated power of 50 watts.
  The technical parameters approved in this decision are for a low-power unprotected FM service. The applicant would have to select another frequency for the operation of the service if required to do so to permit the best use of the frequency band.
 

Conditions of licence

  The licence will be subject to the conditions specified below and to any other condition specified in the licence to be issued.
 

1. The licensee must use the station solely for the purpose of broadcasting pre-recorded welcome messages, paid advertising, and general information relating to tourist sites and events in and around Timmins, except for a maximum of 10 hours per week of "live" broadcasting.

 

2. The licensee must not broadcast more than six minutes per clock hour of advertising material.

 

3. The licensee must not broadcast any musical selection, except as incidental background music.
