New radiocommunication distribution undertaking

1. 9;

The Commission approves the application for a broadcasting licence to carry on a radiocommunication distribution undertaking consisting of a FM radio transmitter at Témiscaming.

2. 9;

Subject to the requirements of this decision, the Commission will issue a licence, expiring 31 August 2007. This licence will be subject to the conditions specified in the licence to be issued.

3. 9;

This undertaking will distribute, in non-encrypted mode, the programming service of CHLM-FM Rouyn-Noranda, on the frequency 103.1 MHz, channel 276A, with an effective radiated power of 1,500 watts.

4. 9;

Témiscaming is currently served by CKVM-FM-1, a CBC affiliate operated by Radio Témiscamingue inc. The Commission is satisfied that CKVM-FM-1 and the CBC proposed new undertaking can co-exist without having an undue negative impact on each other.

5. 9;

The Commission acknowledges the interventions received in support of this application.

6. 9;

The Commission will only issue the licence, and it will only be effective at such time as:

 

· the licensee confirms in writing that it is ready to begin operation. This must take place within 12 months of today's date. Any request for an extension to that deadline requires Commission approval and must be made in writing within that period.

 

· the Department of Industry, having advised that the application is conditionally technically acceptable, has determined that there is no unacceptable interference with NAV/COM services and indicated that it will issue a broadcasting certificate (section 22(1) of the Broadcasting Act).
