Decision CRTC 2001-233

Ottawa, 26 April 2001

CIBM-FM Mont-Bleu ltée
La Pocatière, Saint-Pamphile and Sainte-Perpétue, Quebec 2000-2055-3

Application processed by Public Notice CRTC 2001-9 dated 29 January 2001

Addition of a transmitter of CHOX-FM La Pocatière at Sainte-Perpétue

1.

The Commission approves the application to amend the broadcasting licence for the radio programming undertaking CHOX-FM La Pocatière (the originating station), by authorizing the licensee to add a transmitter at Sainte-Perpétue. The licensee argued that this transmitter will enable it to adequately serve Saint-Pamphile's population.

2.

As proposed, the new FM transmitter will operate on frequency 101.1 MHz, channel 266LP, with an effective radiated power of 16.1 watts.

3.

The technical parameters approved in this decision are for a low-power unprotected FM service. The applicant would have to select another frequency if required to do so to permit the best use of the frequency band.

4.

CFEL-FM Montmagny submitted an intervention opposing this application. The intervener expressed concern that the addition of the transmitter could have financial and technical repercussions on its station. The Commission has noted and is satisfied with the licensee's response to this intervention.

5.

The authority will be effective and the licence will be amended only at such time as:

  • the licensee confirms in writing that it is ready to begin operation of the transmitter. This must take place within 12 months of today's date. Any request for an extension to that deadline requires Commission approval and must be made in writing within that period.

  • the Department of Industry, having advised that the application is conditionally technically acceptable, has determined that there is no unacceptable interference with NAV/COM services and indicated that it will issue a broadcasting certificate (section 22(1) of the Broadcasting Act).
