Subject: Bell Canada and Bell Mobility - Application to review and vary Decision CRTC 2000-745, Changes to the contribution regime

 

Reference:4754-186 and 8662-B2-04/00

 

Application for costs by Action Réseau Consommateur, Fédération des associations coopératives d'économie familiale du Québec and the National Anti-Poverty Organisation (ARC et al.).

By letter dated 13 February 2001, ARC et al. applied for an award of costs in respect of their intervention in the above-referenced proceeding. ARC et al. requested that their costs be fixed at $4,420.21.

ARC et al. submitted that they met the criteria for an award of costs set out in subsection 44(1) of the CRTC Telecommunications Rules of Procedure (the Rules) in that:

 

a) they represent a body of subscribers that has a clear interest in the outcome of the proceeding;

b) they have participated responsibly; and

 

c) they have contributed to a better understanding of the issues through their comments in the proceeding.

By letter dated 12 March 2001, Bell Canada and Bell Mobility stated that they have no objection to the request for costs, or the amount proposed.

 

Commission determination

The Commission considers that ARC et al. have satisfied the criteria for an award of costs set out in subsection 44(1) of the Rules. Accordingly, an award of costs is warranted in the circumstances.

Given the size of ARC et al.'s claim and the relative brevity of this paper proceeding, the Commission considers that this is an appropriate case in which to dispense with taxation and fix the costs in accordance with the streamlined procedure set out in Telecom Public Notice CRTC 98-11.

Further, the Commission has examined the amounts claimed by ARC et al. and considers them to be both reasonably and necessarily incurred.

 

Direction as to costs

The application for an award of costs in respect of the above-mentioned proceeding is approved. Pursuant to subsection 56(1) of the Telecommunications Act, the Commission fixes the costs to be paid to ARC et al. at $4,420.21.

8.

The Commission directs that costs awarded and fixed herein be paid forthwith by Bell Canada and Bell Mobility. Each company shall pay 50% of the costs.
