The Nelvana Channel
On 24 November 2000, the Commission approved a Category 2 specialty television service to be known as The Nelvana Channel. The terms and conditions generally applicable to Category 2 services are set out in the public notice accompanying this and other decisions released today.
Conditions of licence
The licence, when issued, will expire 31 August 2007 and will be subject to the following conditions as well as to those set out in both Public Notice CRTC 2000-171 andin the licence to be issued.
Nature of service
a) The licensee shall provide a national English-language Category 2 specialty television service that will feature predominantly Nelvana-owned, produced or distributed programming, combined with other Nelvana-created programming elements, to create a multi-streamed entertainment channel. The broadcast signal will be windowed into several distinct viewing areas designed to suggest a computer screen. These windows will broadcast simultaneously distinct streams of video, graphics and text. One window will be dedicated to the real-time broadcast of a program from Nelvana's library; the other windows will enhance and extend that program by thematically linking additional Nelvana created programming.
b) The programming must be drawn exclusively from the following categories, as set out in Schedule I to the Specialty Services Regulations, 1990:
2a, 2b, 5a, 5b, 7a, 7b, 7c, 7d, 7e, 7f, 7g, 8a, 8b, 8c, 9, 10, 11, 12, 13 and 14.
c) A minimum of 85% of all programming broadcast during the broadcast day (excluding commercial time) will feature at least two simultaneous programming elements, usually an animated or live action Nelvana program distributed in linear form, accompanied by one or more additional significant programming or other creative elements.
Definitions
Broadcast day shall have the same meaning as that set out in section 2 of the Television Broadcasting Regulations, 1987.
