New very low power seasonal radio services to provide Information on local ferry services
|
1. The Commission approves the applications for broadcasting licences for two very low power non-commercial FM radio programming undertakings operating simultaneously at Tobermory and South Baymouth. Subject to the requirements of this decision, the Commission will issue licences expiring 31 August 2005.

2. The stations will be used to broadcast pre-recorded messages relating to the ferry service which runs between Tobermory and South Baymouth, from April to November. They will provide information such as departure times and loading instructions for the safety and convenience of the travelling public.

3. The Commission has considered the circumstances of these applications and is of the view that it would be appropriate to apply the licensing policy for low power radio broadcasting undertakings set out in Public Notice CRTC 1993-95 dated 28 June 1993.

Conditions of licence

4. The licences are subject to the terms and conditions set out in the licences to be issued. Further, as conditions of licence, the licensee must:
|
· use the stations solely to broadcast pre-recorded information relating to ferry services;
|
· broadcast no advertising material; and
|
· broadcast no musical selections.
|
Technical matters
|
5. As proposed, the two stations will broadcast simultaneously on the frequency 89.9 MHz, (channel 210 VLP), with an effective radiated power of 80 milliwatts.

6. The technical parameters approved in this decision are for very low power unprotected FM services. Accordingly, the licensee would have to select another frequency for the operation of the services should optimum utilization of the broadcasting spectrum so require.
|
7. The licences will only be issued and effective when the new stations are ready to begin operation. When the licensee has completed construction and is prepared to commence operation, it must advise the Commission in writing. If the stations are not constructed and ready to operate within 12 months of today's date, extensions to this time frame may be granted provided that the licensee applies in writing to the Commission before the 12-month period or any extension of that period expires.

8. The Department of Industry has advised the Commission that these applications are conditionally technically acceptable. The Department will only issue Broadcasting Certificates once it has determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

9. In accordance with section 22(1) of the Broadcasting Act, the Commission will only issue the licences and grant the authority to operate when it receives notification from the Department of Industry that its technical requirements have been met, and that Broadcasting Certificates will be issued.
