Licence amendment for CFLZ-FM

1. Following Public Notice CRTC 1998-30 dated 14 April 1998, the Commission approves the application to amend the broadcasting licence for the radio programming undertaking CFLZ-FM Niagara Falls, by changing the frequency from 91.9 MHz (channel 220LP) to 105.1 MHz (channel 286A), and increasing the effective radiated power from 8 watts to 406 watts.

2. The licensee indicated that the change in frequency was required due to the recent approval of frequency 91.7 MHz (channel 219B) for the conversion of CHOW Welland to the FM band in Decision CRTC 97-387 dated 8 August 1997.

3. The Commission received an intervention from Redmond Broadcasting Inc. (Redmond), licensee of CHRE-FM St. Catharines, opposing the application. Redmond indicated that approval of the frequency (105.1 MHz) which is third adjacent to that of its station (105.7 MHz), could cause interference problems.

4. The Commission notes that the Department of Industry has found the technical brief submitted by CFLZ-FM to be acceptable and that the licensee has undertaken to take any necessary measures to alleviate any possible interference to CHRE-FM.

5. The technical parameters approved in this decision are for a low-power unprotected FM service. Accordingly, the licensee would have to select another frequency for the operation of the service should optimum utilization of the broadcasting spectrum so require.

6. The Department of Industry has advised the Commission that this application is conditionally technically acceptable, and that a Broadcasting Certificate will only be issued once it has been determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.

7. In accordance with subsection 22(1) of the Broadcasting Act, the Commission will only issue the licence amendment, and the authority will only be granted, at such time as written notification is received from the Department of Industry that its technical requirements have been met, and that a Broadcasting Certificate will be issued.

This decision is to be appended to the licence.
