Increase in power for CKEY-FM and addition of a transmitter
Following Public Notice CRTC 1996-38 dated 15 March 1996, the Commission approves the application to amend the broadcasting licence for CKEY-FM Fort Erie/Niagara Falls by increasing the effective radiated power from 8,670 watts to 19,700 watts.
The Department of Industry has advised the Commission that this application to amend the licence for CKEY-FM is conditionally technically acceptable, and that a Broad-casting Certificate will only be issued once it has been determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.
In accordance with subsection 22(1) of the Broadcasting Act (the Act), the Commission will only issue the licence amendment, and the authority will only be granted, at such time as written notification is received from the Department of Industry that its tech-nical requirements have been met, and that a Broadcasting Certificate will be issued.
Addition of a transmitter
The Commission also approves the application to amend the broadcasting licence for CKEY-FM by authorizing the licensee to add a transmitter at St. Catharines, operating on frequency 101.1 MHz (channel 266A) with an effective radiated power of 150 watts. The Commission notes that this transmitter has been operating on an experimental basis for some time and is a co-channel, synchronous repeater of CKEY-FM.
In its application, the licensee stated that these changes will improve reception of CKEY-FM throughout its coverage area, particularly within the town of St. Catharines.
In approving these applications, the Commission has considered the views expressed in the opposing intervention submitted by Standard Radio Inc., licensee of CHTZ-FM and CKTB St Catharines, the licensee's response thereto, the potential increase in CKEY-FM's audience and advertising revenues, and the potential impact on existing radio stations.
The Commission is of the view that approval of both requests would result in a modest increase in revenues for CKEY-FM and that the impact on the financial situation of the other competing radio licensees would not be significant.
The authority to add this transmitter will only be effective and the licence will only be amended at such time as construction of the transmitter is completed and it is prepared to commence operation. If the construction is not completed within twelve months of the date of this decision or, where the applicant applies to the Commission within this period and satisfies
the Commission that it cannot complete construction and commence operation before the expiry of this period, and that an extension of time is in the public interest, within such further periods of time as are approved in writing by the Commission, the licence will not be amended. The applicant is required to advise the Commission (before the expiry of the twelve-month period or any extension thereof) in writing, once it has completed construction and is prepared to commence operation.
The Department of Industry has advised the Commission that this application is conditionally technically acceptable, and that a Broadcasting Certificate will only be issued once it has been determined that the proposed technical parameters will not create any unacceptable interference with aeronautical NAV/COM services.
In accordance with subsection 22(1) of the the Act, the Commission will only issue the licence amendment and the authority will only be granted at such time as written notification is received from the Department of Industry that its technical requirements have been met, and that a Broadcasting Certificate will be issued.
This decision is to be appended to the licence.
