New FM radio programming undertaking
|
Following a Public Hearing in the National Capital Region beginning on 15 April 1996, the Commission approves the application for a broadcasting licence for an English-language FM radio programming undertaking at Niagara Falls, on the frequency 91.9 MHz, channel 220LP, with an effective radiated power of 8 watts, to broadcast tourist information during the 1996 summer season and the Winter Festival of Lights in the 1996-97 season.

Subject to the requirements of this decision, the Commission will issue a licence expiring 31 January 1997. This licence will be subject to the conditions specified in this decision and in the licence to be issued.

The applicant requested a two-year term in order to explore the possibility of expanding the scope of its radio service. Nevertheless, the applicant agreed that this investigation can be carried out within a one-year term. Consequently, the Commission has granted a licence term for one year only instead of the two-year term requested by the applicant.

The frequency approved by this decision is an unprotected frequency. Accordingly, the applicant would have to select another frequency for the operation of the station should optimum utilization of the broadcasting spectrum so require.

The Commission notes that the programming on the new undertaking will originate from the studios of CJRN Niagara Falls and will consist of weather, traffic, parking and bridge conditions, together with information relating to events of interest to tourists. The information will be repeated several times each hour, and updated regularly. It is further noted that no commercial messages will be broadcast.

In Public Notice CRTC 1993-95 dated 28 June 1993 and entitled "A Licensing Policy for Low-Power Radio Broadcasting", the Commission stated that the licensees of low-power radio undertakings should be subject to a condition of licence that would define their programming in such a way as to ensure that they do not change their programming and begin to offer the same service as conventional licensees, without Commission approval.

The Commission has considered the circumstances of this application and is of the view that it would be appropriate to apply the policy to it. Accordingly, it is a condition of licence that this station be used solely to broadcast pre-recorded tourist information for the purpose of informing visitors to Niagara Falls. It is also a condition of licence that the service broadcast no advertising material.
