Public Notice CRTC 1995-189
REVISED LISTS OF ELIGIBLE SATELLITE SERVICES
Attached to this Public Notice are revised lists of "Part II Eligible Satellite Services" (Part II list), "Part III Eligible Canadian Satellite Services" (Part III Canadian list), and "Part III Eligible non-Canadian Satellite Services" (Part III non-Canadian list). These lists supersede the lists appended to Public Notice CRTC 1995-8 dated 19 January 1995.
The Part II list (Appendix A) contains satellite services authorized for distribution by licensees holding a Class 1 licence, or a Class 2 licence for an undertaking that has between 2,000 and 6,000 subscribers.
The Part III Canadian and non-Canadian lists (Appendix B) contain satellite services authorized for distribution by licensees holding a Part III licence or licensees holding a Class 2 licence for an undertaking that has fewer than 2,000 subscribers.
Addition of signals delivered by Cancom
In Decision CRTC 95-803 of today's date, the Commission approved applications by Canadian Satellite Communications Inc. (Cancom) to amend its broadcasting licence to carry on a multiple-channel television and radio broadcasting relay distribution undertaking, by adding the signals of CFMT-TV (IND) Toronto, CFCF-TV (CTV) and CFJP-TV (TQS) Montréal, as well as WCVB-TV (ABC) and WBZ-TV (CBS) Boston, Massachusetts, to the list of signals that Cancom is authorized to distribute.
Cancom had been authorized, on 9 March 1994, to distribute WBZ-TV which was then an NBC affiliate.
In order to authorize the distribution of CFMT-TV, CFCF-TV and CFJP-TV by Part III licensees and by Class 2 licensees with fewer than 2,000 subscribers, these signals have been added to the Part III Canadian list. In order to authorize the distribution of WCVB-TV and WBZ-TV by Class 1 licensees and larger Class 2 licensees, on a discretionary tier, and by Part III licensees and Class 2 licensees with fewer than 2,000 subscribers, as part of the basic service or on a discretionary basis, these signals have been added to the Part II list and the Part III Canadian list.
With respect to the addition of the CFCF-TV signal to the Part III Canadian list, the Commission notes that the distribution of this signal by cable licensees is subject to a restriction which requires that where a cable licensee is also distributing the signal of a local CTV affiliate, it shall delete the duplicate programming from the Cancom service or substitute the local service when the programming is identical.
Addition of the service of Television Northern Canada Incorporated
In Public Notice CRTC 1995-129 dated 28 July 1995, the Commission called for comments on a request from Television Northern Canada Incorporated (TVNC) to have its network signal added to Section A of the Part II list and to the Part III Canadian list.
Only two comments were received, both in support of this proposal. The Commission has approved TVNC's request and, accordingly, licensees holding a Class 1 licence or a Class 2 licence for an undertaking that has between 2,000 and 6,000 subscribers may distribute this signal, received via satellite, on a discretionary basis without prior Commission approval. Further, Class 2 licensees having fewer than 2,000 subscribers and Part III licensees, may distribute TVNC, received via satellite, as part of either the basic service or on a discretionary tier without prior Commission approval.
The Commission had also asked for public comments on whether the cable distribution of TVNC should be subject to the Distant Canadian Signals policy as set out in Public Notice CRTC 1993-74. The Commission notes that both interveners considered that the cable distribution of TVNC should not be subject to the policy.
The Commission considers that the carriage of TVNC would have no commercial impact on conventional stations and, accordingly, it has determined that the distribution of TVNC will not be subject to the Distant Canadian Signals policy.
The attached lists have been amended to reflect the changes announced herein.

Authorization for the above-noted services is subject to the following:
- When this list of Part II Eligible Satellite Services is replaced by another list of Part II Eligible Satellite Services, the only authorized services will be those contained in the most recent list; accordingly, this list supersedes the list dated 19 January 1995.
- In the case of Cancom signals, ASN, the CBC English- and French-language Television Services and U.S. satellite services, licensees are required to enter into the necessary contractual arrangements for such carriage.
- Licensees that distribute a PBS signal received at the local head end by terrestrial transmission may distribute one PBS service received from Cancom. All other licensees may distribute a maximum of two PBS services received from Cancom. Licensees may not distribute a duplicate signal of a commercial U.S. network, received from Cancom, unless otherwise authorized pursuant to a condition of licence.

- In the case of CFTM-TV, CFCF-TV and CHAN-TV, a licensee also distributing the signal of a local TVA/CTV affiliate shall delete the duplicate programming from the Cancom services or substitute the local service(s) when the programming is identical.
- Licensees that distribute a PBS signal received at the local head end by terrestrial transmission may distribute one PBS service received from Cancom. All other licensees may distribute a maximum of two PBS services received from Cancom.
